<br />I <br /> <br />I <br /> <br />I <br /> <br />regular meeting, may 29, 1979 <br /> <br />page three <br /> <br />130 <br /> <br />Mr. Pearcy suggested the Council consider making all existing <br />operations non-conforming in nature and allow them to continue <br />to operate under the old ordinances. Mr. Pearcy also pointed <br />out objections to the provisions of the ordinance relating to <br />noise control, privacy fences, parking lot services, the power <br />of immediate suspension of licenses, variances to regulations <br />in the ordinance, and the wording of the paragraph regarding <br />the class C misdemeanor. Mr. Sutton suggested that the City <br />Planning and Zoning Administrator, the City Attorney, and <br />Mr. Pearcy meet to discuss the ordinance and see if a workable <br />solution could be found. Mr. Hyatt submitted Mr. Sutton's <br />suggestion in a form of a motion authorizing the City Attorney, <br />City Manager, the Planning and Zoning Administrator to meet <br />with the Attorney for the Tavern Owners and Operators Association. <br />Mr. Tenorio seconded the motion which passed unanimously. <br /> <br />At 8:55 p.m., the Council recessed at the direction of the Mayor <br />and reconvened at 9:05 p.m. <br /> <br />Dr. W. B. Stouffer came before the City Council with a request <br />that the City close Hamilton and Girard Streets at their <br />intersections with Bishop Street to prevent those streets being <br />used by Castle Forest Subdivision residents as connections to <br />Franklin Drive and Ranch Road 12. Mr. Breihan requested a <br />recommendation from the Planning and Zoning Commission before <br />any decisions were made and stated it would be very difficult <br />to close those streets since it would obstruct traffic out of <br />the Oak Heights Addition on to Bishop Street and because the <br />City would be required to purchase the property and construct <br />cul-de-sacs at the ends of the streets in order to close them. <br />Mr. Breihan also stated that he felt the completion of the Bishop <br />Street reconstruction and improvement would encourage people to <br />use that street rather than driving to Franklin and on to Ranch <br />Road 12. Mr. James moved to direct the City Manager to solicit <br />a recommendation from the Planning and Zoning Commission and to <br />submit that to the Council along with staff recommendations. <br />Mr. Breihan seconded the motion. On roll call, the following <br />vote was recorded: <br /> <br />AYE: Cavazos, Hyatt, Hansen, James, <br />Tenorio, Breihan <br />NAY: None. <br /> <br />Mr. Sutton did not participate in discussion on the item, having <br />taken a seat in the audience for its duration, and did not vote <br />on the motion. <br /> <br />The Mayor introduced for consideration approval of contract <br />documents for sale of the Old City Hall Building and demolition <br />of the City Hall annex. The City Manager recommended the <br />Council consider approval of the demolition contract document <br />for the City Hall annex with the stipulation that demolition be <br />completed prior to sale of the City HaIl Building. He requested <br />the Council decide the extent of the property to be sold and, <br />if desired, a minimum bid price. Mr. Hyatt stating that he felt <br />the buyer should decide whether or not to demolish the annexed <br />building, moved to advertise for the sale of the building and ' <br />annex with the stipulation that the annex&4 building be either <br />demolished or brought up to current building code standard. <br />Mr. Sutton seconded the motion. Mr. Sutton encouraged the <br />Council to sale the lot on which the City Hall Building is <br />located plus a portion of the annex~ lot extending back 35 feet <br />into the lot. Director of Public Safety, Bob Minnie, asked the <br />Council to consider keeping the entire lot on which the annexe& <br />building is located for future Central Fire Station expansion. <br />Mr. Hyatt withdrew his motion, with consent of the seconder, <br />and moved instead to sell only the main City Hall Building and <br />lot. Mr. Sutton seconded the motion. Council further discussed <br />the advisability of keeping the entire annex&Q property lot or <br />only enough for Fire Station parking and appurtenances.
