M. VERAMENDI LEAGUE NUMBER ONE (FURTHER DESCRIBED <br />BY METES AND BOUNDS IN ATTACHED EXHIBITS A, B, AND <br />C), LOCATED SOUTH OF LOWMAN AIRFIELD ALONG INTERSTATE <br />HIGHWAY 35 SOUTH FROM "R-l" (SINGLE FAMILY RESIDENTIAL) <br />TO "I" (INDUSTRIAL). <br /> <br />Mr. Sutton moved the ordinance be approved on first reading. <br />Mr. James seconded the motion which passed unanimously. <br /> <br />The Mayor opened a public hearing to consider a request for <br />a change in the zoning of Lots 8 and 9, Block 1 of Rio <br />Vista Terrace Subdivision from R-l to M. The applicant, <br />Charles Cole, was present to make his request to the Council. <br />It was noted that the Planning and Zoning Commission had <br />recommended approval and received a petition from persons <br />owning more than 20% of the property within two hundred feet <br />of the subject property; therefore, a three-fourth majority <br />vote of the Council was required to approve the ordinance. <br />Mr. Cole said that the two lots had been used as a parking <br />lot for many years and it was his contention that they enjoyed <br />a non-conforming status and could continue to be used for <br />parking. He had requested the zoning change so that he could <br />make improvements on the lot. Mr. Cole was advised by the <br />City Attorney that proof from previous owners would need to be <br />obtained stating that the lots had been used as a parking area <br />since the adoption of the General Zoning Ordinance. <br />Mr. Thomas Darby, owner of property located within 200 feet of <br />Lots 8 and 9, were present to object to the rezoning. <br />Mr. Breihan stated his contention that if the property did enjoy <br />a non-conforming use that he had no objection to changing the <br />zoning since it was better to bring the property up to proper <br />standards. He also requested staff look into the feasibility <br />of paving, curbing, and guttering Roberts Street. Following <br />the public hearing, an ordinance having the fOllowing caption <br />vIas read in its entirety: <br /> <br />AN ORDINANCE AMENDING THE GENERAL ZONING ORDINANCE <br />BY CHANGING THE ZONING OF LOTS 8 AND 9, BLOCK 1 OF <br />THE RIO VISTA TERRACE SUBDIVISION LOCATED AT THE <br />CORNER OF ROBERTS AND SYCAMORE STREETS FROM "R-l" <br />(SINGLE FAMILY RESIDENTIAL) TO "M" (MIXED). <br /> <br />Mr. Cavazos moved the ordinance be approved on first reading. <br />Mr. James seconded the motion which passed unanimously. <br /> <br />The Mayor opened a public hearing to consider an ordinance <br />amending Chapter 27 of the Code of Ordinances by increasing <br />the rates of fare for taxi service in the City. Mr. Joe Cox, <br />Sr., was present to represent the applicant, Doyle Scott. <br />No objections were presented to the rate increase. Following <br />the public hearing, an ordinance having the following caption <br />was read in its entirety: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS, AMENDING SECTION 27-5, ENTITLED <br />"FARES" OF ARTICLE I ENTITLED "TN GENERAL" OF <br />CHAPTER 27, ENTITLED "TAXICABS" OF THE CODE OF <br />ORDINANCES OF SAID CITY, BY REPEALING SUgSECTION <br />(Cl OF SAID SECTION WHICH SET THE RATE OF FARE FOR <br />ALL PASSENGERS OF ANY TAXICAB SERVICE OPERATING <br />WITHIN SAID CITY; ENACTING A NEW SUBSECTION (C) TO <br />SAID SECTION WHICH PROVIDES FOR THE AUTHORIZED RATE <br />OF FARE FOR SAID PASSENGERS; AND ESTABLISHING AN <br />EFFECTIVE DATE. <br /> <br />I <br /> <br />I <br /> <br />I <br />
