<br />ISS <br /> <br />regular meeting, june 25, 1979 <br /> <br />page two <br /> <br />Mr., Cavazos moved the ordinance De approved on first <br />reading. Mr. James seconded the motion which passed <br />unanimously., <br /> <br />The Mayor opened a public hearing to consider a request <br />for a change in the zoning of a 9.85 acre tract out of <br />J., M. Veramendi League #2 from "R-l" to ..D..., The applicant, <br />Cheryl N. Price, was present to request the zoning change. <br />No oojections were presented. It was noted that the Planning <br />and Zoning Commission recommended approval. Mr. Breihan <br />requested an overall development plan of the area Defore <br />further consideration of the ordinance. Mr. Breihan said <br />there were already drainage and traffic proolems in the area <br />and that he felt high density zoning would contrioute to <br />those problems. Mr. Hyatt agreed that there were problems <br />in the area out he felt that due to a housing shortage in <br />San Marcos, that it was important to encourage land <br />development for this use. Mr. Sutton concurred. Pollowing <br />the public hearing, an ordinance having the following <br />caption was read: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF <br />THE CITY OF SAN MARCOS, TEXAS, AMEND~ <br />ING SECTION 3 OF THAT ORDINANCE WHICH <br />REGULATES AND RESTRICTS THE LOCATION <br />AND USE OF BUILDINGS, STRUCTURES AND <br />LAND, DATED MAY 23, 1966 (VOL. 321 BY <br />CHANGING THE ZONING OF A 9.85 ACRE <br />TRACT OUT OF J. M. VERAMENDI LEAGUE <br />#2 (YURTHER DESCRIBED BY METES AND <br />BOUNDS IN THE ATTACHED EXHIBIT Al, <br />LOCATED ON RIVER ROAD, FROM "R-l" <br />(SINGLE FAMILY RESIDENTIAL) TO "D" <br />(MULTI-FAMILY) . <br /> <br />Mr. Cavazos moved to approve the ordinance on first reading. <br />Mr. Hyatt seconded the motion. Following further discussion, <br />Mr. Hyatt requested the motion De amended to defer second and <br />third readings to the regular meeting schedule as opposed to <br />holding further readings at specially scheduled Council <br />meetings for June 26th and June 27th. Mr. Cavazos agreed to <br />the amendment.. On roll call, the following vote was recorded: <br /> <br />AYE: Hansen, James, Sutton, Tenorio, <br />Cavazos', Hyatt <br />NAY: Bre ihan ., <br /> <br />The Mayor opened a public hearing to consider a request for <br />a change in the zoning of a 10.R7 acre tract out of T., J. <br />Chambers Survey from "R-l" to "D". Mr. Robin Pearcy was <br />present to represent the owner and applicant, Mrs. James L., <br />Moore. Mr. Pearcy stated his contention that the property <br />was desira~le for multifamily land use since much of the <br />property in the area was in use as multifamily or had been <br />zoned for multifamily use, particularly the Thomas property <br />located South of the Moore property which had been rezoned <br />to "D" in District Court. Mr., Pearcy said the street <br />easement separating the Moore and Thomas property was not <br />a reasonable barrier. The easement to which Mr. Pearcy <br />referred would be an extension of Holland Street which had <br />been established in the City Comprehensive Plan as the <br />barrier between multifamily and single family residential <br />land use., Mrs. Moore also spoke on her own behalf and was <br />supported by Mrs. D., B. Thomas. Mrs., John Dunn and <br />Mrs. Inez Ramsay, owners of property within 200 feet of <br />the subject property, came before the Council to protest <br />the change in zoning., Both pointed out existing traff.ic <br />problems which, would be aggrevated by more multifamily <br />development and inadequate sewer service. Other persons <br />living in the area who came to object to the zoning change <br />were Harris Koch, C. B. Hutchison, James E. Byrn, and <br />A. Sullivan.
