Mr. Hutchison'described traffic and sewer problems in the neighborhood. Mr. Byrn agreed that traffic on L. B. J. was a problem, particularly since it was so narrow toward the top end, and reminded the Council that, its improvement would be very expensive and difficult to accomplish since some development was so close to the street. Mr. Byrn said that there were other undeveloped sites in the City already zoned for multifamily use which could more easily accommodate a high density residential use and concurred with Mr. Koch that previous Councils and Zoning Commissions, as well as the present groups, had considered the area above Holland Street to be most suitable for single family residential use. After the pUblic hearing, an ordinance having the following caption was read:' I AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, ~MENDING SECTION 3 OF THAT ORDINANCE WHICH REGU- LATES AND RESTRICTS THE LOCATION AND USE OF' BUILDINGS, STRUCTURES AND LAND, DATED MAY 23, 1966 (VOL'. 32) BY CHANGING THE ZONING OF A 10.87 ACRE TRACT OUT OF T. J. CHAMBERS SURVEY (FURTHER DESCRIBED BY METES AND BOUNDS IN THE ATTACHED EXHIBIT A) , LOCATED AT 1410 NORTH L. B. J. DRIVE, FROM "R-l" (SINGLE FAMILY RESIDENTIAL) TO "D" (MULTIFAMILY) . Mr. Breihan moved the request for rezoning be denied. Mr. James seconded the motion. Mr. Breihan informed the Council that the Planning and Zoning Commission had just recently approved another phrase of development for the Hughson Heights Subdivision and that sewerage from that development would be handled by the L. B. J. lift station. He said he didn't think the utility system or the existing streets would support more development than that already approved. On roll call, the motion to deny the request for rezoning passed unanimously. I The Mayor introduced an ordinance which was read in its entirety having the following caption: I AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING ORDINANCE 1979-13, ADOPTED MARCH 26, 1979, WHICH AMENDED CHAPTER 2 1/2 OF THE CODE OF ORDINANCES OF THE CITY OF SAN MARCOS, ENTITLED "ALCOHOLIC BEVERAGES" BY PROVIDING FOR A NEW COMPREHENSIYE LOCAL PUBLIC POLICY REGARDING THE POSSESSION, SALE, AND CON- SUMPTION OF ALCOHOLIC BEVERAGES; BY CHANGING THE REQUIREMENTS PERTAINING TO NOISE; BY CHANGING THE REQUIREMENTS PERTAINING TO PRIVACY FENCES; BY ELIMINATING THE "HARD- SURFACE" REQUIREMENT FOR OFF-STREET PARKING AREA; BY CHANGING THE REQUIREMENTS FOR NUMBER OF PARKING SPACES; BY SETTING PROCEDURES FOR RENEWAL OR REAPPLICATION FOR A CONDITIONAL USE PERMIT; BY SPECIFYING THAT EMERGENCY SUSPENSION OF A CONDITIONAL USE PERMIT SHALL OCCUR ONLY UPON THE FILING OF A WRITTEN STATEMENT; BY DELETING EXAMPLES OF GROUNDS FOR EMERGENCY SUSPENSION; BY SPECIFYING THAT WRITTEN NOTICE SHALL BE PROVIDED TO THE HOLDER AND/OR OWNER OF THE CONDITIONAL USE PERMIT PRIOR TO THE FILING OF A COMPLAINT IN MUNICIPAL COURT; BY DELETING A STATEMENT OF CONSENT TO ENTRY OF' OFFICIALS AND ESTABLISHING AN EFFECTIVE DATE.
