<br />regular meeting, june 25, 1979 <br /> <br />page three <br /> <br />156 <br /> <br />the intent of the Commission that all property above Holland <br />Street be developed for single family residential use. <br />Mr. Hutchison'described traffic and sewer problems in the <br />neighborhood. Mr. Byrn agreed that traffic on L. B. J. was <br />a problem, particularly since it was so narrow toward the <br />top end, and reminded the Council that, its improvement would <br />be very expensive and difficult to accomplish since some <br />development was so close to the street. Mr. Byrn said that <br />there were other undeveloped sites in the City already zoned <br />for multifamily use which could more easily accommodate a <br />high density residential use and concurred with Mr. Koch <br />that previous Councils and Zoning Commissions, as well as the <br />present groups, had considered the area above Holland Street <br />to be most suitable for single family residential use. After <br />the pUblic hearing, an ordinance having the following caption <br />was read:' <br /> <br />I <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE <br />CITY OF SAN MARCOS, TEXAS, ~MENDING <br />SECTION 3 OF THAT ORDINANCE WHICH REGU- <br />LATES AND RESTRICTS THE LOCATION AND USE <br />OF' BUILDINGS, STRUCTURES AND LAND, DATED <br />MAY 23, 1966 (VOL'. 32) BY CHANGING THE <br />ZONING OF A 10.87 ACRE TRACT OUT OF T. J. <br />CHAMBERS SURVEY (FURTHER DESCRIBED BY <br />METES AND BOUNDS IN THE ATTACHED EXHIBIT A) , <br />LOCATED AT 1410 NORTH L. B. J. DRIVE, FROM <br />"R-l" (SINGLE FAMILY RESIDENTIAL) TO "D" <br />(MULTIFAMILY) . <br /> <br />Mr. Breihan moved the request for rezoning be denied. Mr. James <br />seconded the motion. Mr. Breihan informed the Council that the <br />Planning and Zoning Commission had just recently approved another <br />phrase of development for the Hughson Heights Subdivision and <br />that sewerage from that development would be handled by the <br />L. B. J. lift station. He said he didn't think the utility <br />system or the existing streets would support more development <br />than that already approved. On roll call, the motion to deny <br />the request for rezoning passed unanimously. <br /> <br />I <br /> <br />The Mayor introduced an ordinance which was read in its entirety <br />having the following caption: <br /> <br />I <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE <br />CITY OF SAN MARCOS, TEXAS, AMENDING <br />ORDINANCE 1979-13, ADOPTED MARCH 26, 1979, <br />WHICH AMENDED CHAPTER 2 1/2 OF THE CODE OF <br />ORDINANCES OF THE CITY OF SAN MARCOS, <br />ENTITLED "ALCOHOLIC BEVERAGES" BY PROVIDING <br />FOR A NEW COMPREHENSIYE LOCAL PUBLIC POLICY <br />REGARDING THE POSSESSION, SALE, AND CON- <br />SUMPTION OF ALCOHOLIC BEVERAGES; BY CHANGING <br />THE REQUIREMENTS PERTAINING TO NOISE; BY <br />CHANGING THE REQUIREMENTS PERTAINING TO <br />PRIVACY FENCES; BY ELIMINATING THE "HARD- <br />SURFACE" REQUIREMENT FOR OFF-STREET PARKING <br />AREA; BY CHANGING THE REQUIREMENTS FOR <br />NUMBER OF PARKING SPACES; BY SETTING <br />PROCEDURES FOR RENEWAL OR REAPPLICATION FOR <br />A CONDITIONAL USE PERMIT; BY SPECIFYING THAT <br />EMERGENCY SUSPENSION OF A CONDITIONAL USE <br />PERMIT SHALL OCCUR ONLY UPON THE FILING OF <br />A WRITTEN STATEMENT; BY DELETING EXAMPLES <br />OF GROUNDS FOR EMERGENCY SUSPENSION; BY <br />SPECIFYING THAT WRITTEN NOTICE SHALL BE <br />PROVIDED TO THE HOLDER AND/OR OWNER OF THE <br />CONDITIONAL USE PERMIT PRIOR TO THE FILING <br />OF A COMPLAINT IN MUNICIPAL COURT; BY DELETING <br />A STATEMENT OF CONSENT TO ENTRY OF' OFFICIALS <br />AND ESTABLISHING AN EFFECTIVE DATE. <br />
