Mr. Robin Pearcy, attorney for tavern owners and operators in San Marcos, came before the Council to say that his clients endorsed the passage of the ordinance.' Mr. W. C. Carson, Chairman of the Zoning Board of Adjustment and Appeals, came before the Council to say that a problem which had been encountered by the Appeals Board was the determination of marking parking spaces on graveled parking lots. The City Attorney said that she interpreted the parking requirements in the ordinance to mean that adequate space must be provided, not necessarily, that each individual space be marked. Mr. Breihan moved that consideration of the ordinance be tabled to the July 9th meeting. Mr. Tenorio seconded the motion saying he would like to have input from the Zoning Board of Adjustment and 'Appeals and the Planning and Zoning Commission. On roll call, the following vote was recorded: I AYE: Tenorio, Breihan, Cavazos, Hyatt, Hansen, James NAY: Sutton. The Mayor introduced an ordinance which was read in its entirety. The ordinance has the following caption: . AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMEND- ING DIVISION I, ENTITLED "GENERALLY" OF ARTICLE II, ENTITLED "DOGS" AND SECTION 3-46, ENTITLED "FEES", OF ARTICLE III, ENTITLED "IMPOUNDMENT OF ANIMALS", OF CHAPTER 3 ENTITLED "ANIMALS AND FOWL", OF THE CODE OF ORDINANCES OF THE CITY OF SAN ~~RCOS, TEXAS, BY DEFINING "DOG" l\:ND "OWNER"; BY EXPANDING THE DEFINITION OF "AT LARGE"; BY SPECIFYING WHEN A DOG MUST BE PHYSICALLY RESTRAINED FROM LEAVING THE PREMISES OF THE O\~ER OR HANDLER; BY SPECIFYING WHEN DOGS MAY BE IMPOUNDED AND BY WHOM; BY ESTABLISHING NEW FEES FOR IMPOUNDED DOGS AND SETTING AN EFFECTIVE DATE. I Mr. Cavazos moved the ordinance be approved on first reading. Mr. James seconded the motion which passed unanimously. Council Member Hyatt encouraged the persons responsible for circulating the petition to organize a humane society for San Marcos. The Mayor read the caption of a resolution as follows: A RESOLUTION OF THE CITY COUNCIL OF THE CITY'OF SAN MARCOS, TEXAS, ADOPTING A RECOMMENDED FINE SCHEDULE FOR VIOLATIONS OF CHAPTER 3 OF THE CODE OF ORDINANCES OF THE CITY OF SAN MARCOS, TEXAS. I Mr. James moved that the resolution recommending a minimum fine schedule for violation of the animal control ordinance be adopted. Mr. Hyatt seconded the motion which passed unanimously.
