<br />157 <br /> <br />regular meeting, june 25, 1979 <br /> <br />page four <br /> <br />Mr. James moved the ordinance be approved on first reading, <br />Mr. Tenorio seconded the motion. Mr. Robin Pearcy, <br />attorney for tavern owners and operators in San Marcos, <br />came before the Council to say that his clients endorsed <br />the passage of the ordinance.' Mr. W. C. Carson, Chairman <br />of the Zoning Board of Adjustment and Appeals, came <br />before the Council to say that a problem which had been <br />encountered by the Appeals Board was the determination of <br />marking parking spaces on graveled parking lots. The City <br />Attorney said that she interpreted the parking requirements <br />in the ordinance to mean that adequate space must be provided, <br />not necessarily, that each individual space be marked. <br />Mr. Breihan moved that consideration of the ordinance be <br />tabled to the July 9th meeting. Mr. Tenorio seconded the <br />motion saying he would like to have input from the Zoning <br />Board of Adjustment and 'Appeals and the Planning and Zoning <br />Commission. On roll call, the following vote was recorded: <br /> <br />I <br /> <br />AYE: Tenorio, Breihan, Cavazos, Hyatt, <br />Hansen, James <br />NAY: Sutton. <br /> <br />The Mayor introduced an ordinance which was read in its <br />entirety. The ordinance has the following caption: . <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF <br />THE CITY OF SAN MARCOS, TEXAS, AMEND- <br />ING DIVISION I, ENTITLED "GENERALLY" <br />OF ARTICLE II, ENTITLED "DOGS" AND <br />SECTION 3-46, ENTITLED "FEES", OF <br />ARTICLE III, ENTITLED "IMPOUNDMENT OF <br />ANIMALS", OF CHAPTER 3 ENTITLED <br />"ANIMALS AND FOWL", OF THE CODE OF <br />ORDINANCES OF THE CITY OF SAN ~~RCOS, <br />TEXAS, BY DEFINING "DOG" l\:ND "OWNER"; <br />BY EXPANDING THE DEFINITION OF "AT <br />LARGE"; BY SPECIFYING WHEN A DOG MUST <br />BE PHYSICALLY RESTRAINED FROM LEAVING <br />THE PREMISES OF THE O\~ER OR HANDLER; <br />BY SPECIFYING WHEN DOGS MAY BE IMPOUNDED <br />AND BY WHOM; BY ESTABLISHING NEW FEES <br />FOR IMPOUNDED DOGS AND SETTING AN <br />EFFECTIVE DATE. <br /> <br />I <br /> <br />Mr. Cavazos moved the ordinance be approved on first <br />reading. Mr. James seconded the motion which passed <br />unanimously. Council Member Hyatt encouraged the <br />persons responsible for circulating the petition to <br />organize a humane society for San Marcos. <br /> <br />The Mayor read the caption of a resolution as follows: <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF <br />THE CITY'OF SAN MARCOS, TEXAS, <br />ADOPTING A RECOMMENDED FINE SCHEDULE <br />FOR VIOLATIONS OF CHAPTER 3 OF THE <br />CODE OF ORDINANCES OF THE CITY OF <br />SAN MARCOS, TEXAS. <br /> <br />I <br /> <br />Mr. James moved that the resolution recommending a minimum <br />fine schedule for violation of the animal control ordinance <br />be adopted. Mr. Hyatt seconded the motion which passed <br />unanimously. <br />
