<br />l84 <br /> <br />regular meeting, june 26, 1978 <br /> <br />page two <br /> <br />The Mayor introduced for discussion the status of <br />zoning complaints filed in Municipal Court. Mr. Charles <br />Suckle informed the Council that he had filed a complaint <br />of a zoning violation in his neighborhood, that the Judge <br />had ruled it defective, that a second complaint had been <br />filed, and that the property owner, who lives in another <br />city, now refused to accept the letters summoning him to <br />appear in Court and the Judge would not have the case <br />scheduled. The City Attorney and City Manager agreed to <br />see that a summons was served on the property owner. <br /> <br />The Mayor introduced for discussion the extension of <br />utilities to the industrial site on North I. H. 35. <br />Mr. Gordon Thompson, "representing. the' San.'Marcos Iridustrial <br />Foundatiori~' came before the Council to state that a <br />prospective industry had expressed an interest in the 165 <br />acre tract northeast of the City and that the utilities <br />were needed. Mr. Breihan gave a brief history of attempts <br />to develop the property in the past and said the Council <br />had always agreed to extend utilities to the property, but <br />only if a firm committment from the prospective industry <br />could be obtained. By common consent, the Council agreed <br />to consider a resolution stating its intent to ext~nd <br />utilities at the next regular meeting. <br /> <br />The Mayor introduced for discussion Roberts Street. <br />Mr. and Mrs. Charles Cole were present to inform the <br />Council they would like to purchase land except their <br />attorney told them they might have trouble concerning <br />ownership since Roberts Street 8S presently being <br />used, was not within the proper easement and crossed the <br />property in question. Mr. Kotowski reported that the <br />curb on Sycamore Street could be broken out and the street <br />rerouted back into the proper place without great expense. <br />Mrs. Cole requested a letter stating that the City did not <br />intend to acquire prescriptive rights to Roberts Stre~t <br />as it was presently being used. The Council agreed by <br />common consent. <br /> <br />The Mayor next introduced for discussion the use of City <br />Park by travel trailers. Mr. Sutton stated this would; <br />be a profitable idea. The Council agreed to refer the <br />matter to the Parks Board. <br /> <br />The Mayor introduced for discussion the City's compliance <br />with the Texas Department of Water Resources Enforcement <br />Order. The City Manager's report is attached and made a <br />part of these minutes. <br /> <br />The Mayor introduced for consideration bids received on <br />the cleaning of wastewater digester. The lowest bid was <br />from Ace Pipe Cleaning, Inc. for $7,860. Mr. Hyatt moved) <br />the bid be awarded to Ace Pipe Cleaning, Inc. in that <br />amount. Mr. Breihan seconded the motion which passed <br />unanimously. <br /> <br />The Mayor introduced for discussion the proposed Hays <br />County Municipal Utilities district #1. Mr. Ray Kotowski, <br />Director of Public Works, informed the Council there would <br />be a public hearing on June 28, 1978 before the Texas <br />Water Commission and that City Staff members would attend. <br /> <br />The Mayor read the caption of an ordinance as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY <br />OF SAN MARCOS, TEXAS, AMENDING SECTION 3 OF <br />THAT ORDINANCE WHICH REGULATES AND RESTRICTS <br />THE LOCATION AND USE OF BUILDINGS, STRUCTURES <br />AND LAND, DATED MAY 23, 1966 (VOL. 32) BY <br />CHANGING THE ZONING OF LOT 26, BLOCK 1 OF THE <br />ZACK WILLIAMSON ADDITION, LOCATED AT THE CORNER <br />OF MARLTON AND BAYLOR AVENUE, FROM "R-l" (SINGLE <br />FAMILY RESIDENTIAL) TO "c" (COMMERCIAL). <br /> <br />I <br /> <br />I <br /> <br />I <br />
