The City Manager pointed out that the <br />recommendation also included the following statement: "If Mr. Roberts <br />wishes to dedicate the 15' right-of-way for a monetary fee, then <br />this cost will be budgeted for in the fiscal year 1980-81." The <br />recommendations referred to are contained in a document labeled <br />Staff Comments and filed in the official zoning files for the City. <br />On roll call the motion to adopt the ordinance on third and final <br />reading passed with the following vote: <br /> <br />AYE: <br /> <br />Cavazos, Hyatt, Hansen, James, Tenorio, Breihan <br /> <br />I <br /> <br />NAY: None <br /> <br />ABSTAIN: Sutton <br /> <br />The Mayor read the caption of an ordinance as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS, AMENDING SECTION 15.2, ENTITLED <br />"TEMPORARY USE OF LAND BY MOBILE HmmS" OF APPENDIX <br />A, ENTITLED "GENERAL ZONING ORDINANCE" OF THE CODE <br />OF ORDINANCES OF SAID CITY BY DELETING THE PROVISION <br />WHICH MANDATES DENIAL OF AN APPLICATION FOR A PERMIT <br />TO TEMPORARILY PLACE A MOBILE HOME UPON OPPOSITION <br />BY AN rn~ER OF LAND WITHIN TWO HUNDRED (200) FEET IN <br />EACH DIRECTION; BV DELETING THE PROVISION WHICH ALLOWS <br />THE OWNER OF PROPERTY WITHIN TWO HUNDRED (200) FEET <br />OF THE PROPOSED LOCATION TO CAUSE REMOVAL OF THE <br />MOBILE HOME AND DECLARING AN EFFECTIVE DATE. <br /> <br />Mr. James moved the ordinance be adopted on third and final reading. <br />Mr. Breihan seconded the motion which passed unanimously. <br /> <br />The meeting recessed at 9:05 and reconvened at 9:15 at the direction I <br />of the Mayor. <br /> <br />An ordinance having the following caption was read in its entirety: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS, AMENDING SECTION 12-17, ENTITLED <br />"DISPOSAL CHARGES, SANITARY LANDFILL", OF CHAPTER <br />12, ENTITLED "GARBAGE AND TRASH" OF THE CODE OF <br />ORDINANCES OF SAID CITY, BY ESTABLISHING A DISPOSAL <br />CHARGE OF $2.00 PER CUBIC YARD FOR EDUCATIONAL <br />INSTITUTIONS ENGAGED IN THE REMOVAL OF GARBAGE <br />FROM THIER OWN PREMISES LOCATED WITHIN THE CITY <br />LIMITS AND DECLARING AN EMERGENCY. <br /> <br />Mr. James moved the ordinance be adopted on emergey. Mr. Tenorio <br />seconded the motion. Mr. Hyatt stated his contention that educational <br />institutions providing their own collection service and using commercial <br />refuse hauling equipment should be billed at the same rate as commercial <br />refuse haulers. The City Manager informed the Council that the rate <br />ordinance did not represent a comprehensive rate study. The motion to <br />adopt the ordinance as emergency passed unanimously. <br /> <br />The City Manager presented a report on the current status Sanitation I <br />collection system and landfill operation. Mr. Gonzalez informed the <br />Council that the last official report from the Texas Dept. of Health <br />dated October 26, 1979 made reference to a recent inspection of the <br />City landfill operation and stated that based on that report the landfill <br />was being operated in general compliance with state standards.
