<br />120 <br /> <br />regular meeting, april 22, 1974 <br /> <br />page two <br /> <br />AN ORDINANCE AMENDING SECTION 3 OF THAT ORDINANCE WHICH REGULATES <br />AND RESTRICTS THE LOCATION OF BUILDINGS, STRUCTURES AND LAND, <br />DATED MAY 23, 1966 (VOL. 32) BY CHANGING THE ZONING OF THREE <br />ACRES OF LAND OUT OF 9.75 ACRES OF THE T.H.W. FORSYTH SURVEY, <br />LOCATED ON RANCH ROAD 12, FROM "R-l" (SINGLE FAMILY RESIDENTIAL) <br />TO "c" (COMMERCIAL). <br /> <br />Mr. Dibrell moved approval of the Ordinance on first reading. Dr. Tauch <br />seconded the motion. Dr. Craddock asked if National Building Centers, Inc., <br />prospective buyers of the property for construction of a commercial business <br />at that location, accepted the estimates on cost of utilities extension I <br />to the property as prepared by the Director of Public Works (see zoning file <br />#74-10). Mr. Pustejovsky replied that they had not had sufficient time to <br />study the estimates. Dr. Craddock recommended tabling the first reading <br />until an answer could be received. On roll call, the following vote on <br />the motion to approve the ordinance on first reading was recorded: <br /> <br />AYE: <br />NAY: <br />ABSTAIN: <br /> <br />DeLa Rosa, Dibrell, King, Flores, Tauch <br />None <br />Craddock. <br /> <br />The Mayor opened a Public Hearing to consider a request for a change in <br />zoning of 26.55 acres out of the J.M. Veramendi League Number Two, from <br />"R-l" to "R-2". Art Ables was present to represent the applicant, Mrs. <br />Sue Thompson. Mr. Ables requested the Council table the first reading of <br />the ordinance. Clifford Vetters, a property owner within 200 feet of the <br />property in question, came before the Council to object to the change. The <br />mayor closed the hearing and read the caption of an ordinance as follows: <br /> <br />AN ORDINANCE AMENDING SECTION 3 OF THAT ORDINANCE WHICH REGULATES <br />AND RESTRICTS THE LOCATION AND USE OF BUILDINGS, STRUCTURES AND <br />LAND, DATED MAY 23, 1966 (VOL. 32) BY CHANGING THE ZONING OF 26.55 <br />ACRES OF LAND OUT OF THE J.M. VERAMENDI LEAGUE NUMBER TWO, LOCATED <br />BETWEEN BUGG LANE AND OLD STATE HIGHWAY 80, FROM "R-l" (SINGLE FAMILY <br />RESIDENTIAL) TO "R-2" (DUPLEX). <br /> <br />Mr. Flores moved the Ordinance not be approved. Dr. Tauch seconded the <br />motion. On roll call, the following vote was recorded: <br /> <br />I <br /> <br />AYE: <br />NAY: <br />ABSTAIN: <br /> <br />Dibrell, Flores, King, Tauch <br />None <br />DeLa Rosa, Craddock. <br /> <br />The Mayor opened a Public Hearing to consider a request for a change in <br />zoning of .71 acres and .703 acres of the J.M. Veramendi League Number One. <br />Attorney Gerald Klossner was present to represent the applicant, Richard <br />Mason. Mr. Klossner requested the Council table the first reading until <br />a full council was present to act on the ordinance. C.E. Burnett, representing <br />the San Marcos Independent School District, the Reverend Ira Irwin, the <br />Reverend Samuel Montoya and several property owners within 200 feet of the <br />property were present to request the change not be approved. It was noted <br />that a petition signed by more than 20 percent of the property owners within <br />200 feet in objection to the change had been received. The Mayor closed the <br />hearing and read the caption of an ordinance as follows: <br /> <br />AN ORDINANCE AMENDING SECTION 3 OF THAT ORDINANCE WHICH REGULATES <br />AND RESTRICTS THE LOCATION AND USE OF BUILDINGS, STRUCTURES AND <br />LAND, DATED MAY 23, 1966 (VOL. 32) BY CHANGING THE ZONING OF .71 <br />ACRES AND .703 ACRES OF LAND OUT OF THE J.M. VERAMENDI LEAGUE NUMBER <br />ONE, LOCATED AT n05 HIGHWAY 123, FROM "c" (COMMERCIAL) TO "C,..2" <br />(COMMERCIAL) . <br /> <br />I <br /> <br />Mr. DeLa Rosa moved the Ordinance not be approved. Dr. Tauch seconded the <br />motion.
