120 regular meeting, april 22, 1974 page two AN ORDINANCE AMENDING SECTION 3 OF THAT ORDINANCE WHICH REGULATES AND RESTRICTS THE LOCATION OF BUILDINGS, STRUCTURES AND LAND, DATED MAY 23, 1966 (VOL. 32) BY CHANGING THE ZONING OF THREE ACRES OF LAND OUT OF 9.75 ACRES OF THE T.H.W. FORSYTH SURVEY, LOCATED ON RANCH ROAD 12, FROM "R-l" (SINGLE FAMILY RESIDENTIAL) TO "c" (COMMERCIAL). Mr. Dibrell moved approval of the Ordinance on first reading. Dr. Tauch seconded the motion. Dr. Craddock asked if National Building Centers, Inc., prospective buyers of the property for construction of a commercial business at that location, accepted the estimates on cost of utilities extension I to the property as prepared by the Director of Public Works (see zoning file #74-10). Mr. Pustejovsky replied that they had not had sufficient time to study the estimates. Dr. Craddock recommended tabling the first reading until an answer could be received. On roll call, the following vote on the motion to approve the ordinance on first reading was recorded: AYE: NAY: ABSTAIN: DeLa Rosa, Dibrell, King, Flores, Tauch None Craddock. The Mayor opened a Public Hearing to consider a request for a change in zoning of 26.55 acres out of the J.M. Veramendi League Number Two, from "R-l" to "R-2". Art Ables was present to represent the applicant, Mrs. Sue Thompson. Mr. Ables requested the Council table the first reading of the ordinance. Clifford Vetters, a property owner within 200 feet of the property in question, came before the Council to object to the change. The mayor closed the hearing and read the caption of an ordinance as follows: AN ORDINANCE AMENDING SECTION 3 OF THAT ORDINANCE WHICH REGULATES AND RESTRICTS THE LOCATION AND USE OF BUILDINGS, STRUCTURES AND LAND, DATED MAY 23, 1966 (VOL. 32) BY CHANGING THE ZONING OF 26.55 ACRES OF LAND OUT OF THE J.M. VERAMENDI LEAGUE NUMBER TWO, LOCATED BETWEEN BUGG LANE AND OLD STATE HIGHWAY 80, FROM "R-l" (SINGLE FAMILY RESIDENTIAL) TO "R-2" (DUPLEX). Mr. Flores moved the Ordinance not be approved. Dr. Tauch seconded the motion. On roll call, the following vote was recorded: I AYE: NAY: ABSTAIN: Dibrell, Flores, King, Tauch None DeLa Rosa, Craddock. The Mayor opened a Public Hearing to consider a request for a change in zoning of .71 acres and .703 acres of the J.M. Veramendi League Number One. Attorney Gerald Klossner was present to represent the applicant, Richard Mason. Mr. Klossner requested the Council table the first reading until a full council was present to act on the ordinance. C.E. Burnett, representing the San Marcos Independent School District, the Reverend Ira Irwin, the Reverend Samuel Montoya and several property owners within 200 feet of the property were present to request the change not be approved. It was noted that a petition signed by more than 20 percent of the property owners within 200 feet in objection to the change had been received. VERAMENDI LEAGUE NUMBER ONE, LOCATED AT n05 HIGHWAY 123, FROM "c" (COMMERCIAL) TO "C,..2" (COMMERCIAL) . I Mr. DeLa Rosa moved the Ordinance not be approved. Dr. Tauch seconded the motion.
