<br />121 <br /> <br />regular meeting april 22, 1974 <br /> <br />page three <br /> <br />,Mr. King opened a Public Hearing to consider a request for a change in <br />zoning of Lots 112 and 113 in the Park Addition, Third Division from <br />"R-l" (single family residential) to "c" (commercial). Attorney Thomas <br />Harwood was present to represent the applicant, Lyndon Herring. Mr. Harwood <br />presented at that time an amended application for the zoning change to show <br />the present zoning classification as "Mil (mixed). Dr. Pat Norwood and <br />Mr. Curtis Jenkins as well as a representative of Treehouse Apartments were <br />present to object to the change. It was noted that a petition signed by more <br />than 20 percent of the property owners within 200 feet of the property in <br />question had been presented in objection to the change. The Mayor closed the <br />hearing and read the caption of an ordinance as follows: <br /> <br />I <br /> <br />AN ORDINANCE AMENDING SECTION 3 OF THAT ORDINANCE WHICH REGULATES <br />AND RESTRICTS THE LOCATION AND USE OF BUILDINGS, STRUCTURES AND: <br />LAND, DATED MAY 23, 1966 (VOL. 32) BY CHANGING THE ZONING OF LOTS <br />112 AND 113 IN THE PARK ADDITION, THIRD DIVISION, LOCATED AT 828 <br />CHESTNUT STREET, FROM "M" (MIXED) TO "C" (COMMERCIAL). <br /> <br />Mr. DeLe Rosa moved the Ordinance not be approved. Dr. Craddock seconded the <br />motion. On roll call, the following vote was recorded: <br /> <br />AYE: Craddock, DeLa Rosa, Dibrell, King,Flores <br />NAY: Tauch. <br /> <br />Mr. King read the caption of an ordinance as follows: <br /> <br />AN ORDINANCE OF THE CITY OF SAN MARCOS, TEXAS, AMENDING THAT CERTAIN <br />ORDINANCE DATED SEPTEMBER II, 1972, WHICH VACATED, ABANDONED, AND <br />CLOSED CERTAIN PORTIONS OF ACADEMY, JAMES, NORTH AND ALAMO STREETS <br />IN SAN MARCOS, TEXAS, AND AUTHORIZED THE EXECUTION OF A QUITCLAIM <br />DEED FROM SAID CITY TO SAN MARCOS BAPTIST ACADEMY, BY REPEALING THE <br />LEGAL DESCRIPTION OF SAID STREETS, AND SUBSTITUTING IN ITS PLACE A <br />NEW LEGAL DESCRIPTION FOR THE CLOSING AND ABANDONING OF SAID STREETS. <br /> <br />I <br /> <br />Mr. King explained that the legal description of the original ordinance was <br />ambiguous and that the change had been approved by city staff and representatives <br />of the Academy. Mr. Flores moved the Ordinance be approved on first reading. <br />Mr. Dibrell seconded the motion, which passed unanimously. <br /> <br />The Mayor read the caption of an ordinance as follows: <br /> <br />AN ORDINANCE CLOSING AND ABANDONING EZELL STREET AND A PORTION OF <br />PEGUES STREET IN THE H.A. NELSON FIRST ADDITION TO SAN MARCOS, <br />TEXAS, AND RELINQUISHING TO HUGH A NELSON, JR. AND MARIAN NELSON <br />MEEKS ALL RIGHT, TITLE AND INTEREST OF THE CITY OF SAN MARCOS, TEXAS <br />IN AND TO EZELL STREET AND THE NORTHWEST 983.5 FEET OF PEGUES <br />STREET AND DIRECTING THE MAYOR TO EXECUTE AND DELIVER TO SAID <br />PERSONS QUITCLAIM DEEDS TO EZELL STREET AND SAID PORTION OF <br />PEGUES STREET, AND DECLARING AN EMERGENCY. <br /> <br />Mr. Dibrell moved the Ordinance be amended to delete the emergency clause <br />and passed on first reading. Mr. Flores seconded the motion, which passed <br />unanimously. <br /> <br />The Mayor read the caption of an ordinance as follows: <br /> <br />I <br /> <br />AN ORDINANCE CLOSING AND ABANDONING AN EXTENSION OF PEGUES STREET <br />AT ITS TERMINATION AT THE NORTHWEST END OF H.A. NELSON FIRST ADDITION <br />TO THE CITY OF SAN MARCOS TO BLUEBONNET DRIVE AND RELINQUISHING TO <br />MARIAN NELSON MEEKS, HUGH A. NELSON, JR., AND REUBEN H. MEEKS ALL <br />RIGHT, TITLE AND INTEREST OF THE CITY OF SAN MARCOS IN AND TO SUCH <br />AN EXTENSION OF PEGUES STREET TO BLUEBONNET DRIVE AND DIRECTING THE MAYOR <br />TO EXECUTE AND DELIVER TO SAID PERSONS QUITCLAIM DEEDS OF THE EXTENSIONS <br />OF PEGUES STREET TO BLUEBONNET DRIVE, AND DECLARING AN EMERGENCY. <br /> <br />Mr. Dibrell moved the Ordinance be amended to delete the emergency clause <br />and passed on first reading.
