<br />r <br />I <br /> <br />re~ular meeting, febru~rY 14, 1972 <br /> <br />pilge two <br /> <br />It was brought out thilt the Planning & Zoning Commission <br />had approved the annexation, subject to dedic~tion of <br />15 feet of right-of-way for widening LBJ Drive. Deed to <br />the right-of-way on two of the parcels had been received <br />by the City. On motion of Mr. King, and second of Mr. <br />Dela ROSil, the matter was tabled by unanimous vote until <br />the deed to the right-of-way on the third tract is received <br />by the City. <br /> <br />The Mayor introduced for consideration an ordinance tilbled <br />at the previous meeting. Caption is as follows: <br /> <br />AN ORDINANCE AMENDING SECTION 3 OF THAT ORDINANCE <br />WHICH REGULATES AND RESTRICTS THE LOCATION AND USE <br />OF BUILDINGS, STRUCTURES AND LAND, DATED MAY 23, <br />1966 (VOL. 32) BY CHANGING THE ZONING OF A 6.95- <br />ACRE TRACT FACING RANCH ROAD 12, FROM "R-l" (SINGLE- <br />FAMILY RESIDENTIAL) TO "C" (COMMERCIAL) <br /> <br />I <br /> <br />Mr. King moved approval of the Ordinance on first reilding. <br />Mr. Flores seconded the motion, which passed unanimously. <br /> <br />The Mayor opened a public hearing on a request for change <br />of zoning on property described:lots 17,18,19,20,21 and 22, <br />South End Addition. Request was from "M" (Mixed) to "C" <br />(Commercial). <br />Miss Andrea Torres, whose home is on an adjacent lot, object- <br />ed to the change of zoning. She cited the increase in traffic <br />if a warehouse were built on the property, and the danger to <br />children in the area. She also questioned the legality of <br />"spot zoning". <br />John Finch, representing John Stokes, owner of the pro~erty, <br />said the proposed warehouse would be used to store furniture I <br />not in use at apartment buildings. He said they did not <br />anticipate much activity in the areil. HelTecounted their <br />long effort to get the property rezoned, and reminded the <br />Council that the Planning & Zoning Commission had given <br />unanimous ilpproval to the request at the second public hearing. <br />Miss Torres spoke again, and said many of the neighbors did <br />not want the change, but had not attended the second hearing <br />because of the severe weather on that date. <br />The Mayor closed the public hearing. <br />Mr. Dela Rosa moved that the change of zoning be denied. <br />Mrs. Emery seconded the motion. <br />During the discussion which ensued, with Councilmen and Harris <br />Koch, Chairman of the Planning and Zoning Commission participat- <br />ing, the question of a possibility of higher taxes being im- <br />posed on property in the area, if commer~ial improvements were <br />made, was again introduced. Mr. Dela Rosa explained that in <br />addition to the possibility that taxes might be increased, he <br />felt the property itself did not 'meet proper requirements for <br />commercial use. He cited drainage as a serious problem in <br />the neighborhood, and said there was a possibility that il major <br />thoroughfare might be built near there. H'e' addeill that there <br />had been too much opposition from the residents at the various I <br />hearings for the Council to ignore. Mr. Flores silid he wished <br />it were possible to be sure what the tax status would be if <br />the property were zoned for commercial use. The question being <br />called for, the following vote was recorded: <br /> <br />AYE: DeLa Rosa, Emery, Etheredge, Flores <br />NAY: King, Tauch, Yarbrough <br /> <br />The Mayor declared the motion carried, and the request for <br />change of zoning denied. <br />
