NELSON'S FIRST ADDITION TO THE CITY OF <br />SAN MARCOS~ HAYS COUNTY, TEXAS, OF RECORD IN VOL. <br />89, PAGE 224, HAYS COUNTY DEED RECORDS; RELIN- <br />QUISHING TO EXA PHILLIPS NE~SON, MARIAN NELSON <br />MEEKS, HUGH A. NELSON, JR., AND REUBEN MEEKS, <br />TRUSTEE, ALL RIGHT, TITLE AND INTtREST OF THE <br />CITY OF SAN MARCOS, TEXAS, IN AND TO SAID STREET <br />PORTIONS; AND DIRECTING THE MAYOR OF THE CITY OF <br />SAN MARCOS TO EXECUTE AND DELIVER To SAID PERSONS <br />A QUIT-CLAIM DEED TO SAID STREET PORTIONS <br /> <br />I <br /> <br />Mr. Yarbrough moved adoption of the ordinance on third <br />and final reading. Mr. Zavesky seconded the motion. <br />Councilman King said it should be made public that this <br />ordinance involved an exbhagge of property between the <br />Nelson Estate and the City. The Mayor said that fact <br />has already been made public. On roll calL the following <br />vote was recorded: <br /> <br />AYE: Flores, King, Smith, Yarbrough, Zavesky <br />NAY: None <br /> <br />The Mayor declared the Ordinance Passed, Approved and <br />Adopted. <br /> <br />In introducing discussion on Planning & Zoning matters, <br />the Mayor read aloud a letter from Mr. and Mrs. D.B. Thomas, <br />see attached. Approval of a request for rezoning,of the <br />Thomas property by the Planning & Zoning ,Commission was ~iden <br />with the provision that Mr. &Mrs. Thomas would dedicate <br />20 feet of right-of-way needed to widen Lyndon B. Johnson <br />Drive. Mr. and Mrs. Thomas agreed in the letter to give the <br />right-of-way, but with the stipulation that when LBJ Drive <br />is paved, with curb and gutter, no assessment would be levied <br />against their property. <br />When asked for an opinion, the City Manager said the right-of- <br />way requested from Mr. and Mrs. Thomas was a little more than <br />the City would ordinarily expect to take without compensation. <br />Mr. Flores brought out that in a recent. case , a property-owner <br />had agreed to "give whatever footage necessary for widening <br />LBJ" , without cost to the City. He said thi s seemed to have <br />established a precedent. Mr. Flores said perhaps the City <br />could do the paving, and Mr. and Mrs. Thomas could be responsible <br />for putting in the curb abd gutter. Mrs. Thomas rejected this <br />tentative proposal. Mr. King suggested Mrs. Thomas go back to <br />the Planning & Zoning Commission and discuss the question in the <br />light 'of her proposal. Mrs. Thomas said the Council would have <br />to make a decision ate! this meetin!:), since her husband refused <br />to go to another meeting. Mr. Flores then asked .Mrs. Thomas if <br />she would be interested in the City's having the 20-ft. right-of- <br />way appraised, and then try to work out a satisfactory solution <br />to the problem. Mrs,. Thomas. rejected this idea,. also. <br />Mr. Yarbrough said if Mrs. Thomas wouldn't consider the City's <br />proposals, he felt the Council could not make a decision <br />contrary to the Planning & Zoning Commission's reco,mmendation. <br />He suggested Mrs. Thomas discuss the City's proposals with her <br />husband. The Mayor asked Mrs. Thomas to write the City about <br />the matter, if she and her husband did not intend to appear <br />at a Council meeting again. Mr. Flores moved that the request <br />for rezoning be tabled. Mr. Yarbrough seconded the motion, <br />which passed unanimously. <br /> <br />I <br /> <br />I <br />
