<br />regular meeting, may 11, 1970 <br /> <br />page two <br /> <br />AN ORDINANCE PROVIDING FOR THE EXTENSION OF <br />CERTAIN BOUNDARY LIMITS OF THE CITY OF SAN <br />MARCOS, TEXAS, AND THE ANNEXATION OF CERTAIN <br />TERRITORY CONSISTING OF APPROXIMATELY 280ACRES <br />OF LAND, WHICH SAID TERRITORY LIES ADJACENT TO <br />AND ADJOINS THE PRESENT BOUNDARY LIMITS OF THE <br />CITY OF SAN MARCOS, TEXAS <br /> <br />Mr. King seconded the motion and on roll call, the <br />following vote was recorded: <br /> <br />I <br /> <br />AYE: Contreras, Craddock, Flores, King, Smith, <br />Yarbrough, Zavesky <br /> <br />NAY: None <br /> <br />The Mayor declared th~ Ordinance Passed, Approved and <br />Adopted. <br /> <br />U~derPlanning &20ning matters, ~he Council considered <br />a request for ch~nge of zoning on property located in the <br />400cblock of North Guadalupe Street. Presently zoned "0" <br />(multi -family) and "P-2" (public use), property -owners <br />requestElda change to "C" (commercial). A copy of the <br />letter from the Planning & Zoning Commission to the Council <br />is attached as a part of the Minutes. The second item under <br />Planning & Zoning matters on the agenda was related to the <br />first, since it related to an alternate thoroughfare plan. <br />Councilman King moved that items "a" and "b" under "Planning <br />and Zoning Matters" be tabled for further study. Councilman <br />Yarbrough seconded the motion. <br />W.C. Carson, agent for the property-owners, came before the <br />Council to protest further delay on his request for ~ezoning. <br />He reminded the Council that a similar request for rezoning <br />on this property had been turned down 14 months ago. He ask- <br />ed for a workshop for discussion of the matter with Planning <br />and Zoning Commissioners, so that the situation might be <br />clarified. The Mayor agreed that a workshop should be held. <br />The question being called for, the following vote was recorded: <br /> <br />I <br /> <br />AYE:Contreras, Craddock, Flores, King, Smith, Yarbrough, <br />Zavesky <br /> <br />NAY:None <br /> <br />The Mayor declared the motion carriedc <br /> <br />Frank Pennington camebefor~the Council to request a publid <br />hearing on his application for i change of zoning. He said <br />the Planning andZonini Commssionhad declined to hold a <br />hearing. Mr. Yarbrough moved that the CityCduncil hold a <br />public hearing on Mr. Pennington's request for a change of <br />zoning on property located at 422 W. Hutchison. Mr. King <br />seconded the motion. Mr. Fl6res said he felt the Council <br />should not override Planning and Zoning Commission decisions <br />except under ~xtrao~dinaryc6nditions. 'On roll call, the <br />following vote~as recorded: <br /> <br />I <br /> <br />AY'E: Contreras, Craddock, King, Smith ,Yarbrough, Zavesky <br />NAY: Flores <br /> <br />The Mayor declared the motion carried. <br /> <br />The Council discussed a recommendation from the Planning and <br />Zoning Commission that the Bluebonnet Drive area should be <br />annexed. Dr. Craddock moved that Mr. Bean be requested to <br />update the cost of furnishing water and seWer service to the <br />Bluebonnet Drive area. Mr. King seconded the motion, which <br />passed unanimously. <br />
