<br />. <br /> <br />. <br /> <br />I <br /> <br />company having a right or franchise to operate its business in such <br />city; and the placing, construction and manner of erecting such <br />structures, if any, of the grantee herein, his heirs and assigns, <br />shall at all times be subject to the control of the City Council of <br />the City of San Marcos, in order to protect the rights and conven- <br />iences of third parties and the public generally within such city. <br />FOURTH. The full control and management of such streets, high- <br />ways, bridges, viaducts and public ways is expressly reserved in <br />the City of San Marcos. <br />FIFTH. This franchise, as well as the rights hereunder, may be <br />assigned by the~antee herein, as well as by all succeeding grantees <br />at their option, or the rights of such grantee or successors hereunder <br />may be transferred under foreclosure proceedings or judicial sale, <br />or may be transferred from the holder to a third party by the opera- <br />tion of forfeiture clause of any agreement between such persons, in <br />which case assignees shall succeed to all of the rights, duties and <br />liabilities of the grantee hereunder, such assignments shall be sub- <br />jeot to the approval of the City Commission. <br />SIXTH. During the operation of the business of transporting <br />passengers by motor bus under this franohise-ordinance, the grantee; <br />his heirs and assigns, shall pay to the City of San Maroos a bonus, <br />consisting of the sum of Fifty Dollars ($50.00) for each motor bus <br />put into operation during the first year of the operation of suoh <br />business, and consisting of the sum of Fifty Dollars ($50.00 for <br />each motor bus put into operations or a sum that is equal to two <br />(2) per cent of the gross receipts of such business, during the <br />second or any subsequent year of operation, whichever sum shall be <br />the greater. Said bonus is deemed and declared to be an adaquate <br />and reasonable compensation for the rights granted under this fran- <br />chise-ordinance. The gross receipts herein contemplated is that sum <br />representing said receipts prior to any aocounting or payment of <br />state or federal inoome taxes by the grantee, his heirs and assigns; <br />but said gross receipts shall not inolude any income earned from <br />advertising within the motor busses. <br /> <br />I <br /> <br />I <br />
