<br />I <br /> <br />I <br /> <br />'I <br /> <br />. <br /> <br />. <br /> <br />An annual report, in affidavit form, reflecting the total gross <br />receipts for said second or any subsequent year of operation, <br />shall be due within thirty (30) days following the end of said <br />second or any subsequent year of operation. Said report shall be <br />signed and sworn to by the grantee, his heirs and assigns. Should <br />said grantee, his heirs and assigns, operate such business less than <br />a full year during the second or any SUbsequent year of operation, <br />and if grantee, his heirs and assigns, shall have fully complied <br />with all terms of this franchise-ordinance, then said grantee, his <br />heirs and assigns, shall be liable to pay to the City of San Marcos, <br />only two (2) per cent of the gross receipts of such business for the <br />period actually operated during the second or any subsequent year, <br />with full credit for each $50.00 paid at the beginning or during <br />said second or any subsequent year of operation to be allowed in <br />favor of the grantee, his heirs and assigns. <br />SEVENTH. For the purpose of ascertaining that the rights, <br />privileges and liabilities granted in this franchise-ordinance shall <br />be and remain within the bounds thereof and for such other purposes <br />as are lawful, the City Council may inspect and examine or cause to <br />be inspected and examined at all reasonable hours all books of <br />account of such grantee, his heirs and assigns, which books of account <br />shall be kept and such reports made as shall be required by said city <br />in accordance with the forms and methods prescribed by the City <br />Council. <br />EIGHTH. The rights of grantee, his heirs or assigns, to cease <br />operating hereunder ( and in connection therewith of removing any or <br />all of his, his heirs or assigns, properties) when, but only in the <br />event that, a reasonable return is not being earned therefrom for a <br />period of thirty (30) continuous days, is recognized and agreed to <br />by the City of San Marcos. <br />~. Each motor bus operated by the grantee, his heirs and <br />assigns, under the terms of this franchise-ordinance, shall have <br />plainly painted, on each side and the rear of said bus, a sign giving <br />the name, or trade name or firm name under which such motor bus is <br />being operated. <br />TENTH.
