<br />. <br /> <br />. <br /> <br />I <br /> <br />after the final passage of this franchise-ordinance within which <br />to accept same, said acceptance to be in writing, and to begin the <br />operation of such transporation of passengers by motor bus system; <br />provided that in case of non-acceptance or of a failure to begin <br />operation within such time, the franchise-ordinance and rights here- <br />by given shall become null and void and shall be forfeited to the <br />City of San Marcos, and in all things terminated. <br />ELEVENTH. Upon acceptance of this franchise-ordinance, as above <br />prOVided, grantee shall file with the City Councilor its duly <br />appointed agent a schedule of designated routes to be operated over, <br />under, along and across the streets, highways, bridges, viaducts and <br />publiC ways of the City of San Marcos. Such schedule of routes shall <br />not be extended or modified until notice in writing of such extension <br />or modification be given to the Oity Councilor its duly appointed <br />agent. <br />TWELFTH. Upon acceptance of this franchise-ordinance, as above <br />prOVided, and upon any change in the ownership of said business, <br />~antee, his heirs and assigns, shall file with the City CounCil, or <br />its duly appointed agent, a written affidavit, signed and sworn to <br />by the grantee, his heirs and assigns, stating the following: <br />(a) His (or their) name and place of residence, character and <br />value of his (or their) assets and what portion. if any. of such <br />assets are exempt from forced sale, the liabilities of such grantee, <br />his heirs and assigns. and how, if at all such liabilities are secured, <br />and whether any other person, firm or corporation owns any interest <br />in the business, and what person or corporation owns any title or <br />interest in any motor bus to be operated under this franchise. <br />(b) The Name, usual trade description, equipment, rated horse <br />power and factory number of all motor busses placed, or later placed. <br />in operation under the terms of this franchise-ordinance, and as <br />nearly as practicable the year in which said motor busses were manu- <br />factured or first used. <br />(c) The stand or stands at which the motor busses will remain <br />while not en route, and the depots where same will be housed when not <br />in actual service. <br />(d) The rated seating capacity of such motor busses. <br /> <br />J <br /> <br />1 <br />
