<br />. <br /> <br />. <br /> <br />- <br /> <br />The above described public liability insurance or surety bond <br />shall be for the protection of the passengers of said motor busses <br />and for the public, but shall not cover personal injuries sustained <br />by the servants, agents, or employees of the grantee, his heirs and <br />assigns. The insurance company or bonding company issuing said <br />policy of insurance or bond, as provided in this franchise-ordinance, <br />shall at the time of the issuance of said policy or bond, issue a <br />certificate to the City of San Marcos, specifically providing that <br />such insurance policy or bond shall not be cancelled by such company <br />issuing the same until after ten days notice of intention to cancel <br />same has first been given to the Mayor of the City of San Marcos. <br />The City of San Marcos shall not be deemed to have assumed any <br />responsibility for the SOlvency of any insurance or bonding company, <br />or in any manner to have become liable for any sum on account of any <br />claim against the grantee, his heirs or assigns, or in any manner <br />to become liable on account of any act or omission of any officer or <br />officers of the City of San Marcos, in connection with any matter <br />relating to such motor bus operation or ownership, due to the passage <br />of this franchise-ordinance by the City of San Marcos or the accept- <br />ance of and operation under the same by the grantee, his heirs and <br />assigns. <br />Nor shall the lawful liability of the grantee, his heirs or <br />assigns, be in any manner limited or enlarged by anything in connec- <br />tion with this franchise-ordinance or such insurance policy or bond, <br />but persons having any cause of action against the said grantee, his <br />heis and assigns, or having a cause of action secured by said policy <br />or bond shall be authorized to sue upon such insurance policy or <br />bond without impleading the City of San Marcos. <br />FOURTEENTH. A failure upon the part of the grantee, his heirs <br />and assigns, to observe the terms and restrictions of this franchise- <br />ordinance, shall, if contunued or persisted in after due notice in <br />wX'iting fX'om the City Council to the grantee, his heirs and assigns, <br />and due opportunity to observe this franchise-ordinance or to remedy <br />any non-observance thereof, be grounds for the forfeiture and termi- <br />nation of all rights and privileges under this grant. <br /> <br />J <br /> <br />, <br />
