<br />"' <br /> <br />I <br />I. <br /> <br />I <br /> <br />:) <br /> <br />//Vl <br /> <br />RES 0 L UTI 0 N <br /> <br />HERETOFORE, Cecil Hahn, a resident citizen of <br />the City of San Marcos, duly and formally announced his <br />intention to file, and did file, proper application to be- <br />come a candidate for a place on the City Council of the City <br />of San Marcos at the City election to be held on April 3,1956. <br />Subsequent to the announcement of the said Hahn of his <br /> <br />candidacy for said office, it was determined that there is <br /> <br /> <br />some question as to whether he could legally serve as a member <br /> <br />of the governing body of the City of San Marcos, and also in <br />his present capacity as a Professor at Southwest Texas State <br />Teachers College in San Marcos, Texas, he being an employee <br />of the State of Texas in the latter connection. In view of <br />the rJregoing, the said Cecil Hahn has petitioned this city <br /> <br />Council to remove his name from the ballot to be used at the <br />said City election on April 3, 1956, the application of the <br />said Hahn to withdraw his name from said ba llotbeing in the <br />form of a letter ~hich is as follows: <br /> <br />"San Marcos, Texas~ March 28,1956 <br />Honorable Frarik E. Dietterich, Mayor <br />and Members of the City Council. <br />City of San Marcos, <br />San Marcos, Texas <br />Gentlemen: <br />I previously announced my intention to seek <br />a place on the City Council of the City of San Marcos, At the <br />time I did this, I did not know there was any question as to <br />whether I could serve on the CityCouncil,in addition to re~ <br />taining my emp~oyment with the State of Texas as a Professor in <br />Southwest Texas state Teachers College. <br />Since a.nnouncing for the above office, I have <br />learned there is some question about the legality of my being on <br />the City Council, and, at the same time, serving as a Professor <br />at the College. I further understand the law is not well settled <br />on this matter, and that recent opinions of the Attorney General <br />of the State of Texas have been conflicting on the point. While <br />I would like very much to. serve on the City Council it is my <br />be lief that, in the circumstances, the best interest of the City, <br />as well as my own best interest, would be served if I withdraw <br />from the race for City Council until this matter is finally settled. <br />In view of the foregoing, I will appreciate it <br />very much if you will delete my name from the balLot to be used in <br />the City election on April 3, 1956. <br />Sincerely yours, <br />/s/ Cecil Hahn <br /> <br />l <br />
