<br />jf'Ya- <br /> <br />STATE OF TEXAS <br />COUNTY OF HAYS <br /> <br />KNOW ALL MEN BY THESE PRESENTS: <br /> <br />I <br /> <br />THIS AGREEMENT, is made ani entered into by and between Rogers <br />Enterprises, a partnership comprised of Mrs. Lorene Bering, Paul J. Rogers, <br />Mrs. Grace James ani Mrs. Dorys McKinnon, herein called "Lessor", and the <br />City of San Marcos, a MUniCipal Corporation situated in Hays County, Texas <br />herein called "Lessee" <br />WIT N E SSE T H: <br />Lessor is the owner of the fee Simple title to all of that property <br />lying and being situated in the County of Hays, State of Texas, and being <br />that property known as the Spring Lake Golf Course, situated near the head <br />of the San Marcos River, being the same golf course now operated by Lessee <br />on what is known as the Spring Lake Hotel Property. There is incltXied in <br />said property the said nine hole golf course and all of the ground now used <br />in connection with the golf course and also included in said property is a <br />small building, which is now being used as a club house and golf shop, <br />situated at the eastern or southeastern corner of said Spring Lake Hotel <br />property and fronting on the old post road. There is also included in this <br />property all of the other structures on said golf course, including shelters, <br />tee box, and benches now being used in connection therellitlr. <br />Lessor has agreed to and does hereby lease and demise unto Lessee the <br />above described property, all upon the terms and conditions as hereinafter <br />stated, and Lessee has agreed to and does hsreby lease from lessor the above <br />described property upon the terms and conditions as hereinafter stated. <br />This lease shall be for a term of two years, commencing on January 1, <br />1958, and terminating on December 31, 1960, unless sooner terminated under <br />the terms and provisions of this contract. <br />As consideration for this lease, lessee agrees to :pay to lessor, the <br />sum 01' One Hundred ($100.00) Dollars per month, payable monthly in advance <br />or the sum of Six Huaired ($600.00) Dollars, semi-annually, payable in <br />advance. The first monthly payment, or semi-annually payment of rent shall <br />be due and payable on the date of this contract, and a further :payment in the <br /> <br />'I <br /> <br />I <br /> <br />-1- <br />
