26 <br /> <br />Regular Meeting <br /> <br />April 27, 1981 <br /> <br />Page 2 <br /> <br />Mrs. Norris moved that the Ordinance be adopted and Mr. Tarbutton <br />seconded the motion, which passed unanimously. <br /> <br />Mr. Stokes asked if there were any names to be considered for the <br />vacancy on the Fair Housing Commission. There were no nominees, <br />so the matter was passed. <br /> <br />Mr. Stokes introduced for consideration the appointment of Carol <br />Grimm as a member of the Environmental Advisory Board, such name <br />placed in nomination by Karl W. Brown. Mr. Brown asked that the <br />consideration of Carol Grimm's appointment be tabled until such <br />time as further nominees are submitted. <br /> <br />Mr. Stokes opened a public hearing to consider the annexation of <br />6.178 acres out of J. M. Veramendi League No. Two, known as the <br />Cummings' property. Mr. Kyle Averitt, one of the partners who <br />wishes to develop the property once it is annexed, spoke in favor <br />of annexing the property to the City. No one opposed the annexation. <br />The Mayor Pro-Tem then closed the public hearing. Mr. Brown moved <br />that the consideration for annexation of the property be placed on <br />the May 11, 1981 agenda for first reading and Mrs. Norris seconded <br />the motion. On roll call the following vote was recorded: <br /> <br />AYE: Brown, Cavazos, Stokes and Norris. <br /> <br />NAY: Tarbutton. <br /> <br />ABSTAIN: None. <br /> <br />(Mr. James was still not present when this motion was considered). <br /> <br />Mr. Stokes introduced for consideration the petition of Walt <br />Schmeltekopf for annexation of 7 acres of land out of J. M. Vera- <br />mendi League No. Two, also known as the Moss Cliff Restaurant. <br />Mr. Kenneth Sutton advised the Council that the property was in <br />need of City sewage hookup to be operable. Mr. Robert Barnhart <br />from the local State Health Department advised that the waste water <br />septic tank system could not meet health standards and for that reason <br />the restaurant had to be closed. Mr. Tarbutton moved that the consi- <br />deration of Mr. Schmeltekopf's petition be placed on a future agenda <br />for public hearing when the Staff had prepared a report on their re- <br />commendations for annexation and Mrs-. Norris seconded the motion, <br />which passed unanimously. <br /> <br />Mr. Stokes introduced for consideration the extension of utilities <br />to the 7 acres of land out of J. M. Veramendi League No. Two (Moss <br />Cliff Restaurant). Mrs. Norris moved that utilities be extended to <br />the property, as per policy, and Mr. Tarbutton seconded the motion, <br />which passed unanimously. <br /> <br />Mr. Stokes introduced for consideration an Ordinance on first reading <br />on the annexation of 66 acres out of the J. M. Veramendi League No. <br />Two, also known as the Barker-Warren property. The Ordinance was <br />read in its entirety, the caption of which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS ANNEXING TO SAID CITY A CONTIGUOUS <br />TRACT OF LAND CONTAINING APPROXI~.~TELY 66 ACRES, <br />MORE OR LESS, LOCATED WITHIN THE EXTRATERRITORIAL <br />JURISDICTION OF SAID CITY AND LYING ADJACENT TO PRE- <br />SENT CITY BOUNDARIES; EXTENDING THE BOUNDARY LIMITS <br />OF SAID CITY SO AS TO INCLUDE SAID TRACT; GRANTING <br />TO THE INHABITANTS OF SAID TRACT ALL THE RIGHTS AND <br />PRIVILEGES OF OTHER CITIZENS OF SAID CITY; BINDING <br />SAID INHABITANTS BY ALL OF THE ACTS AND ORDINANCES, <br />RULES AND REGULATIONS OF SAID CITY AND DECLARING AN <br />EFFECTIVE DATE. <br /> <br /> <br />
