c:;,y' WHEREA~, it is believed to be to the best interest of the City of ~an Marcos to h.ve as its administrative head a person especially qualified and trained in municipal administration; and, WHERE~, on the 16th day of July 1957, the Governing Body of the City of :;an Marcos, Texas employed such a. person as adminis- trative officer, designated as city manager, to direct and supervise the complex municipal operation; and, I WHEREA~, at that time it was the intent of the Governing Body to establish by ordinance the duties and responsibilities of said city manager, but, through oversight the ordinance was not adopted; and, WHEREA~, it is the desire of the Governing Body to correct the omission, through the adoption of the following ordinance; AN ORDINANCE CREATING THE OFFICE OF CITY MANAGER FOR THE CITY OF 1iAN MARCOS; FIXING THE TERM OF OFFICE; PRE~CRIBING HIS POWERS AND DUTIE~; AND PROVIDING FOR HIS COMPEN~ATION. BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF ;,AN MARCo;', TEXA:; ~ection 1. There is hereby created the position of city manager for the City of ~an Marcos. He shall be the adminis- trative head of the municipal government under the direction and supervision of the Governing Body. The city manager mayor may not be a resident of the city at the time of his appointment, but during the term of his office he shall reside within the City of ~an Marcos. The city manager shall hold office at the pleasure of the Governing Body or as otherwise provided. I ~ection 2. The powers, duties and responsibilities of the tity manager shall be: I a. To devote all his working time and attention to affairs of the City and be responsible to the Govern- ing Body for the efficient administration of its affairs; b. To see that all laws and ordinances are enforced; c. To appoint and remove all department heads and subordinate employees, subject, if requested, to review and confirmation by the Governing Body; d. To exercise supervision and control over all departments of the City or those that may hereafter be created by the Governing Body; e. To attend all regular and special meetings of the Governing Body with the right to take part in the discussion; f. To recommend to the governing body, in writing, from time to time, such measures as he may deem necessary or expedient; g. To see that all terms and conditions imposed in favor of the City of :;an Marcos or its inhabitants, in any public utility franchise are faithfully kept and performed and, upon knowledge of any violation thereof, to call the same to the attention of the governing body; h. To act as budget officer and to prepare and submit to the governing body, prior to the beginning of each fiscal year, a budget of the proposed expenditures and revenue for the ensuing year, showing in as much detail as is necessary the estimated require- ments for the efficient operation of each department and the reason therefore; i. To make and file a budget as required by State Laws; j. To make a written report to the governing body as soon as practicable after the close of each month's operation, showing the operation and income as compar- ed with the annual budget, and to keep the governing body advised at all times of the financial condition and needs of the city;
