<br />c:;,y' <br /> <br />WHEREA~, it is believed to be to the best interest of the <br />City of ~an Marcos to h.ve as its administrative head a person <br />especially qualified and trained in municipal administration; and, <br /> <br />WHERE~, on the 16th day of July 1957, the Governing Body <br />of the City of :;an Marcos, Texas employed such a. person as adminis- <br />trative officer, designated as city manager, to direct and supervise <br />the complex municipal operation; and, <br /> <br />I <br /> <br />WHEREA~, at that time it was the intent of the Governing <br />Body to establish by ordinance the duties and responsibilities of <br />said city manager, but, through oversight the ordinance was not <br />adopted; and, <br /> <br />WHEREA~, it is the desire of the Governing Body to correct <br />the omission, through the adoption of the following ordinance; <br /> <br />AN ORDINANCE CREATING THE OFFICE OF CITY MANAGER <br />FOR THE CITY OF 1iAN MARCOS; FIXING THE TERM OF <br />OFFICE; PRE~CRIBING HIS POWERS AND DUTIE~; AND <br />PROVIDING FOR HIS COMPEN~ATION. <br />BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY <br />OF ;,AN MARCo;', TEXA:; <br /> <br />~ection 1. There is hereby created the position of <br />city manager for the City of ~an Marcos. He shall be the adminis- <br />trative head of the municipal government under the direction and <br />supervision of the Governing Body. The city manager mayor may not <br />be a resident of the city at the time of his appointment, but <br />during the term of his office he shall reside within the City of <br />~an Marcos. The city manager shall hold office at the pleasure <br />of the Governing Body or as otherwise provided. <br /> <br />I <br /> <br />~ection 2. The powers, duties and responsibilities <br />of the tity manager shall be: <br /> <br />I <br /> <br />a. To devote all his working time and attention to <br />affairs of the City and be responsible to the Govern- <br />ing Body for the efficient administration of its <br />affairs; <br />b. To see that all laws and ordinances are enforced; <br />c. To appoint and remove all department heads and <br />subordinate employees, subject, if requested, to <br />review and confirmation by the Governing Body; <br />d. To exercise supervision and control over all <br />departments of the City or those that may hereafter <br />be created by the Governing Body; <br />e. To attend all regular and special meetings of <br />the Governing Body with the right to take part in <br />the discussion; <br />f. To recommend to the governing body, in writing, <br />from time to time, such measures as he may deem <br />necessary or expedient; <br />g. To see that all terms and conditions imposed in <br />favor of the City of :;an Marcos or its inhabitants, <br />in any public utility franchise are faithfully kept <br />and performed and, upon knowledge of any violation <br />thereof, to call the same to the attention of the <br />governing body; <br />h. To act as budget officer and to prepare and submit <br />to the governing body, prior to the beginning of each <br />fiscal year, a budget of the proposed expenditures <br />and revenue for the ensuing year, showing in as <br />much detail as is necessary the estimated require- <br />ments for the efficient operation of each department <br />and the reason therefore; <br />i. To make and file a budget as required by State <br />Laws; <br />j. To make a written report to the governing body <br />as soon as practicable after the close of each month's <br />operation, showing the operation and income as compar- <br />ed with the annual budget, and to keep the governing <br />body advised at all times of the financial condition <br />and needs of the city; <br />
