<br />AN ORDINANCE RELEASING A CERTAIN WATER LINE <br />EASEMENT, AND ALL OTHER RIGHTS, TITLE AND <br />INTEREST OF THE CITY OF SAN MARCOS, IN AND TO <br />LOT NO. TWO (2) IN BLOCK NO. THREE (3) AND <br />ADJOINING PROPERTY IN THE ENOCH MOORE ADDITION <br />TO THE CITY OF SAN MARCOS UNTO B. L. DAILEY <br />AND NIFE, AND AUTHORIZING THE MAYOR TO EXECUTE <br />AN INSTRUMENT OF RELEASE <br /> <br />I <br /> <br />BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF <br /> <br />SAN MARCOS, IN HAYS COUNTY, TEXAS: <br /> <br />That the City of San Marcos, as the present owner of <br /> <br />the water works system located and situated in said municipality, <br /> <br />and as successor to San Marcos Water Company, shall remise, re- <br /> <br />lease, relinquish and discharge, unto B. L. Dailey and Frances <br /> <br />Dailey, the easement and all right, title and interest which the <br /> <br />said city has by virtue of the instrument from p,. R. Turner to <br /> <br />San Marcos Water Company, dated June 16, 1883, recorded in Vol- <br /> <br />ume R, pages 218-220, Hays County Deed Records, and the Mayor, <br /> <br />C. M. Allen, under the corporate seal of the city, is directed, <br /> <br />authorized and empowered to execute and deliver to the said <br /> <br />I <br /> <br />B. L. Dailey and Frances Dailey, husband and wife, a proper <br /> <br />instrument of release and relinquishment as to all said rights <br /> <br />in and to Lot No. Two (2) in Block No. Three (3) of Enoch Moore <br /> <br />Addition to said city, and any adjoining property owned by <br /> <br />B. L. Dailey and Frances Dailey and fronting on Navarro Street <br /> <br />in said city. <br /> <br />On motion duly made and seconded, with all aldermen <br /> <br />present and voting in favor thereof, the said ordinance or <br /> <br />resolution was duly passed, and the rule that ordinances be read <br /> <br />on three several days is suspended, and same shall take effect <br /> <br />and be in force from and after its passage, and it is so <br /> <br />ordained. <br /> <br />I <br /> <br />THIS the 31st day of August, 1961. <br /> <br />~?l' <br /> <br />ATTEST: <br /> <br /> <br />t~ @. ~ <br /> <br /> <br />City Secretary <br />
