<br />EFFECTIVE DATE OF EN-
<br />FORCEMENT.
<br />
<br />BE IT ORDAINED by the Gov-
<br />erning Body of the City of San
<br />Marcos, that:
<br />Section 1. LICENSE FEE,
<br />There is here-by fixed and assess-
<br />ed as a police regulation for the
<br />protection of the public health a
<br />license fee of ONE DOLLAR
<br />($1.00) per annUm against the
<br />Owner or keeper of each and
<br />every dog kept in the City of San
<br />Marcos. The license shall run
<br />from August fitst of each year to
<br />July thirty-first of the succeeding
<br />year, and any part of such year
<br />be deemed and considered the en-
<br />tire year.
<br />S ec t ion 2. VACCINATION
<br />AGAINST RABIES, It shall be
<br />th.e duty of the owner or keeper
<br />of each and every dog kept in the
<br />City of San Marcos to have such
<br />dog vaccinated against rabies by
<br />a practicing veterinarian at least
<br />once each year, provided, how-
<br />ever, that such dog must have
<br />been vaccinated within one
<br />month of the date the owner or
<br />keeper's application for the li-
<br />cense as herein required.
<br />Section 3. LICENSE TAG, It
<br />shall be the duty of the City Tax
<br />Assessor - Collector to provide
<br />suitable metal tags for said dogs,
<br />w hicbl tags shall evidence the
<br />payment of the license fees and
<br />the registration of said dog. Each
<br />person owning or keeping a dog
<br />within the limits of the City of
<br />San Marcos shall apply to the
<br />City Tax Assessor-Collector for a
<br />tag, and upon payment of said li-
<br />cense fee and presentation of a
<br />certificate by a practicing veteri-
<br />narian showing that said dog has
<br />within one month of the date of
<br />application for license been vac-
<br />cinated against rabies, the Tax
<br />Assessor-Collector shall supply
<br />to each applicant a tag suitable to
<br />be fastened upon a collar around
<br />the dog's neck, and shall keep in
<br />a book kept for such purpose,
<br />register the number of said tag,
<br />the name and address of the
<br />owner or keeper of the dog, and
<br />a description of said dog, and no
<br />license shall be issued unless the
<br />application is accompanied by
<br />such veterinarian's certificate. It
<br />shall be the duty of the owner or
<br />keeper of each dog to apply to
<br />

<br />said officer for such license, pay
<br />the fee for same, and obtain a
<br />tag therefor, and to have and to
<br />keep said tag at all times during
<br />the year securely fastened around
<br />the neck of said dog, and the fail-
<br />ure of the owner in this respect
<br />shall ha ve teh same effect as if no
<br />license had been paid upon said
<br />dog,
<br />Section 4, LOST TAGS, It
<br />shall be the duty of the owner or
<br />keeper of any dog to procure a
<br />duplicate tag from the City Tax
<br />Assessor-Collector in the event
<br />that the original tag is lost or de.
<br />strayed and the Tax Assessor~
<br />Collector shall issue a duplicate
<br />tag upon application of any per~
<br />son who has complied with the
<br />provisions of this ordinance and
<br />upon payment of fifty cents (50c)
<br />to COver the cost of issuing the
<br />duplicate tag.
<br />Section 5, UNLAWFUL TO
<br />KEEP, It shall be unlawful for
<br />any person to keep any dog in
<br />the limits of the City of San
<br />Marcos for which the license
<br />herein provided has not been
<br />procured from the Tax Assessor.
<br />Collector, and which has not been
<br />vaccinated for rabies and upon
<br />which the tag herein above pro-
<br />vided for is not at all times fast-
<br />ened around the neck of such
<br />dog.
<br />Section 6, POUND MASTER.
<br />The City Manager shall appoint a
<br />special officer to be known and
<br />described as the Pound Master
<br />and fix a salary therefor, subject
<br />to the approval of the Governing
<br />Body, and the ,City Manager may
<br />appoint or provide for an assist-
<br />ant or assistants. to the Pound
<br />Master. The Pound Mas-tel' and
<br />his assistant or assistants shall be
<br />under supervision and control of
<br />the City Manager, It shal! be the
<br />duty of the Pound Master and
<br />his assistants to pick up and im-
<br />pound all unlicensed do~s found
<br />running at large, to take proper
<br />for all dogs impounded, to de-
<br />stroy all dogs that have not been
<br />redeemed or sold and to perform
<br />such other duties as may be di-
<br />rected by the City Manager un-
<br />der the terms of this Ordinance.
<br />Section 7, REPORTS. It shal!
<br />be the duty of the Pound Master
<br />to report in writing to the City
<br />Manager once each month the
<br />total number of dogs impounded,
<br />the total number of dogs redeem-
<br />ed or sold, and the total number
<br />of dogs killed under the provi-
<br />sions of this Ordinance.
<br />
<br />Section 8, PO U N D FEES,
<br />There shall be charged a pound
<br />fee of ONE DOLLAR ($1.00) for
<br />each and every dog impounded
<br />under the provisions of this Ordi-
<br />nance and an additional fee of
<br />ONE DOLLAR ($1.00) per day
<br />for each day or fraction thereof
<br />such dog shall remain in said
<br />pound.
<br />Section 9, REDEMPTION OF
<br />IMPOUNDED DOGS, The own,
<br />er or keeper of any dog or dogs
<br />captured or impounded under the
<br />provisions of this Ordinance shall
<br />be permitted and allowed to re-
<br />deem, reclaim, and receive pos-
<br />session of said dog or dogs with.
<br />in seventy-two (72) hours after
<br />said dog or dogs have been im-
<br />pounded. upon payment to the
<br />City of San Marcos of the pound
<br />fee as provided in Section 8 of
<br />this Ordinance, and in addition
<br />thereto, the payment of the Ii-
<br />cenae fee as provided in Section 1
<br />of this Ordinance if said dogs
<br />have not been previously licensed
<br />for the current year.
<br />Sectlon 10, DISPOSITION OF
<br />UNCLAIMED DOGS. Should the
<br />owner or keeper of any impound~
<br />ed dog or dogs fail to redeem
