<br />this Ordinance within the seven-
<br />ty.two (72) hours provided, then
<br />said dog or dogs shall be destroy-
<br />ed in a manner approved by the
<br />American Humane Society. At
<br />any time subsequent to expira-
<br />tion of redemption period and
<br />prior to destruction of any dog
<br />under provisions hereof, the City
<br />of San. Marcos' may sell any dog
<br />so impounded to first person ten-
<br />dering to the City the pound fees
<br />and license fees provided for in
<br />this ordinance.
<br />Section 11, VICIOUS DOGS,
<br />It shall be unlawful for any own-
<br />er or person in control of any
<br />vicious ar dangerous dog to keep
<br />or permit the same in o-r about
<br />any public house, public place,
<br />street, or alley in the City of San
<br />Marcos.
<br />Section 12, UNLAWFUL TO
<br />HEMOVE LICENSE TAG, It
<br />shall be unlawful for any person
<br />to willfully take or remove from
<br />any dog a collar or tag.
<br />Section 13, RESTRAINING
<br />FEMALE DOGS DURING
<br />",,_-OESTRUS. It shall be unlawful
<br />for any female dog; whether li-
<br />censed or not, to run at large on
<br />the streets of San Marcos during
<br />said dog's oe?~rual period and
<br />any such dog'that shall be found
<br />running at large during such
<br />period shall be placed in the City
<br />Dog Pound by the Pound Master
<br />or his duly authorized represen-
<br />tative; provided) however, that
<br />the owner or keeper of said dog
<br />may reclaim same at anytime by
<br />paying an impounding fee of
<br />ONE DOLLAR ($-,00) plus a fee
<br />of ONE DOLLAH ($1.00) for each
<br />day or portion thereof said dog is
<br />kept in the City Dog Pound; pro-
<br />viding, furthe:r, that in event said
<br />dog shall not be claimed and
<br />above fees paid, then said dog
<br />shall be disposed of as provided
<br />in Section 10 herein.
<br />Section 14, "DUMPING" OF
<br />DOGS WITHIN CITY LIMITS
<br />PHOHlBITED, It shall be un-
<br />lavTful for any person Or persons
<br />to "dump" or leave unattended
<br />for an unreasonable period of
<br />time any dog or dogs within the
<br />city limits of San Marcos.
<br />Section 15, CONFINEMENT
<br />OF DOGS UNDER CERTAIN
<br />CONDITIONS, If any dog, wheth-
<br />er vaccinated or not, shall have
<br />bitten, scratched or otherwise at-
<br />tacked any person, the owner of
<br />such dog, or any person having
<br />kno\1.,~ledge of the incident~ shall
<br />immediately notify the Health
<br />Officer and Pound Master and
<br />the dog shall be confined in the
<br />City Dog Pound or at a veteri-
<br />nary hospital for a period of
<br />twenty-one (21) days at the ex,
<br />pense of the owner or keeper of
<br />the dog. This time limit may be
<br />reduced only by the joint written
<br />approval of the City Health Offi-
<br />cer and the City Veterinarian, but
<br />in no instance shall it be less
<br />than ten (10) consecutive days,
<br />not including the day of im-
<br />poundment. No dog held for ob-
<br />servation shall be released with~
<br />out the written permission of the
<br />Health Officer or his authorized
<br />representative. Any dog suffering
<br />from the- bite of a rabid animal
<br />shall be quarantined in a veteri-
<br />nary hospital, the expense of the
<br />same to be paid by the Owner or
<br />keeper of the dog, for a period
<br />of six (6) months. Under no cir-
<br />cumstances shall the dog so quar-
<br />antined be released to the own-
<br />er or keeper nor the dog be al-
<br />lowed to remain on the premises
<br />of the owner or keeper. It shall
<br />be the duty of all practicing vet-
<br />erinarians to report to the Health
<br />Officer all cases of rabies or sus-

<br />pected rabies which shall come
<br />to his attention.
<br />Section 16, KEEP I N G OF
<br />HOGS WITHIN CITY LIMITS,
<br />The keeping of pigs, hogs, swine
<br />or any member of the Suidae
<br />family in the city limits of San
<br />Marcos shall be prohibited,
<br />Section 17, CATI'LE, HORSES,
<br />ETC, It shall be unlawful to per.
<br />mit any catt1e~ horses, jacks, jen~
<br />nets, sheep, goats or like animals
<br />to run at large within the City of
<br />San Marcos or to be upon the
<br />premises of any person other
<br />than the owner. The pen or pens
<br />where such animals are confined
<br />shall be kept in a clean and sani-
<br />tary manner at all times and shall
<br />be subject to inspection by the
<br />Health Officer or his representa-
<br />tive at all times between sunrise
<br />and sunset. The droppings or fe-
<br />cal matter from such animals
<br />shall be disposed of in a sanitary
<br />manner and shall not be placed
<br />in any garbage ~an or other con-
<br />tc~iner for removal by the City,
<br />No animal as defined in this Sec-
<br />tion shall be staked in a manner
<br />which will permit it to graze up-
<br />on any sidewalk> street or other
<br />public property within the city
<br />limits of San Marcos.
<br />Section 18, FOWLS, It shall
<br />be unlawful for any person or
<br />persons, firm or corporation, hav-
<br />ing under their control or owner-
<br />ship, any chicken, goose, ducI:.
<br />turkey or other fowl to permIt
<br />the same to run at large. All
<br />fowls shall be confined in suitable
<br />sanitary pens or cages which pens
<br />or cages shall be subject to in-
<br />spection by the Health Officer or
<br />his representative at any time
<br />between sunrise and sunset to de-
<br />termine what the provisions of
<br />this Section are being complied
<br />with. The droppings and/or
<br />other fecal matter shall be dis-
<br />posed of in a sanitary manner
<br />and shall not be placed in a gar-
<br />bage can or other container for
<br />disposal by the City,
<br />Section 19, SAVINGS CLAUSE,
<br />If any section, part, word.
<br />phrase, clause Or sentence or any
<br />provision of this Ordinance is de~
<br />elared unconstitutional or inv21~
<br />id, then, in that event, it is ex-
<br />pressly provided, and it is the
<br />intention of the Governing Body
<br />in passing this Ordinance, that an
<br />other parts of this Ordinance
<br />shall not be affected thereby and
<br />shall remain in full force and ef-
<br />fect.
<br />Section 20, MAKING VIOLA-
<br />TION A MISDEMEANOR. Any
<br />person who shall violate any of
<br />the provisions of this Ordinance
<br />shall be deemed quilty of a mis-
<br />demeanor and upon conviction
<br />thereof shall be fined not ex-
<br />ceed One Hundred Dollars
<br />($100,00), and each and every
<br />day of such violation shall be
<br />deemed a separate offense.
<br />Section 21. REPEALING OR.
<br />DINANCES IN CONFLICT, All
<br />ordinances or parts of ordinances
<br />in conflict with the terms of this
<br />ordinance are hereby repealed.
<br />Section 22, EFFECTIVE DATE
<br />OF ENFORCEMENT, This Ordi-
<br />nan-ce shall be in effect after its
<br />legal publication or August 1,
<br />1962, whichever shall last occur.
