<br />~ <br />17 <br /> <br />Adjourned Meeting August 21, 1962 <br /> <br />page 3 <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THECTTY OF <br />SAN MARCOS, TEXAS, That we urge that this Amendment, known as HJR 32, <br />be defeated by the people ,of San Marcos, Texas." ' <br /> <br />I <br /> <br />Alderman Ruiz made a suggestion that the discussion on HJR 32 <br />be tabled u~til the September meeting and it was sO agreed. <br /> <br />The City Manager announced that the Hon. Homer Thornberry had notified <br />the City on August 7th that the property surplus to the Federal Fish <br />Hatchery could be pirchased from the General Services Administration. <br />Alderman Ruiz moved that the City Manager be authorized to make the <br />purchase of the property fronting on the San Marcos River at the quoted <br />price of $2000. GSA stated this was half the a~praised value. <br />Alderman Younger seconded the motion, which passed unanimously. <br /> <br />V' <br /> <br />The City Manager presented a request for preliminary approval of <br />Highland Terrace Subdivision No.3, adjacent to the City Limits. <br />Alderman Swift moved that the matter be passed until the preliminary <br />requirements are met, in compliance with the Subdivision Ordinance. <br />Alderman Ruiz seconded the motion, which passed unanimously. <br /> <br />The City Manager offered the opinion that there may be certain <br />conflicts between the Subdivision Ordinance of June 26, 1957, and the <br />Ordinance adopted Jan. 23, 1951, and requested that the City Attorney <br />be asked for a ruling. Alderman Swift made a motion that the matter <br />be referred to the City Attorney, to ascertain whether the City's <br />contracts with Feltner and Rogers are spurious. Alderman Stokes offered <br />the opinion that it would be contrary to the best interests of the City <br />to cast doubt on the validity of the contracts. The motion died for <br />want of a second. <br /> <br />I <br /> <br />The City Manager stated that representatives of the bond buyers and <br />bondholders would be the best source for an opinion on the question. <br />Alderman Ruiz moved that such an opinion be requested. Alderman Stokes <br />seconded the motion. The roll when taken was as follows: <br /> <br />AYES: <br />NAYS, <br /> <br />MOORE, RUIZ, STOKES AND YOUNGER <br />SWIFT <br /> <br />Whereupon the Mayor declared the motion carried. <br /> <br />The City Manager reported that the study of the required street <br />lighting for the McNaughton and College Courts Additions had been <br />completed. This is the first of three areas to be studied for adequate <br />lighting. The first project consisted of approximately 30 lights; <br />however, the City Manager requested that six additional lights be <br />authorized to complete the street lighting pattern, to tie in along <br />Chestnut Street with existing lighting on North Austin Street. <br />Alderman Swift asked when lighting requirements for the South End and <br />Victory Gsrden area would be completed. He was advised that this was <br />next on the list. It was Mr. Swift's desire that an attempt be made to <br />incorporate the two areas into one project. Alderman Stokes moved that <br />the City Manager be authorized to notify L.C.R.A. to proceed with the <br />immediate installation of the lights. Alderman Younger seconded the <br />motion, which passed unanimously. <br /> <br />I <br /> <br />Bids received on the annual supply of chlorine were submitted by <br />the City Manager. All bids were for $11 per CWT, and the City Manag~r <br />suggested Alamo Welding Company of Austin, Texas, be given the bid, <br />since it had been given the two previous years to Thompson-Hayward. <br />Alderman Younger moved that the bid be given to Thompson-Hayward. <br />Alderman Ruiz seconded the motion. Alderman Stokes amended the motion <br />to include sending a copy of the MJdScitlll1'theoAt1Hlrney General of the State. <br />Alderman Swift offered a second amendment to the effect that the City <br />Attorney be asked for an opinion on whether the bids might be in <br />violation of the Anti-Trust Law, and that a copy of the action be sent <br />to each bidder. The twice-amended motion was passed unanimously. <br /> <br />~ <br />
