APPLICATION FOR PERMIT; INVESTIGATION OF APPLICATION; PUBLIC NECESSITY BEFORE ISSUANCE; ESTABLISHING HOURS OF OPERATION; PROHIBITING ALCOHOLIC BEVERAGES; PROVIDING FOR ADMINISTRATIVE CHARGES AND LICENSE TAX; PROVIDING FOR SUSPENSION OF PERMIT; INSPECTIONS; CONTAIN- ING A SEVERABILITY CLAUSE; ESTABLISHING A PENALTY FOR VIOLATION; AND, ESTABLISHING AN EFFECTIVE DATE SECT I ON I. DEFINITIONS: The following definition is hereby ad~pted for the construction and interpretation of this ordinance. The term "Pool or Bi II iard Table" as used herein shall mean any table sur- rounded by a ledge or cushion, with or without pockets, upon which bal Is are propelled by a stick or cue, and where the player thereon does not or is not required to make a coin deposit causing an electrical connection of any nature or kind before such game may be actually com- menced. "I SECTION LL. PERMIT REQUIRED: It shal I be unlawful for any person, firm, association or persons, corporat- ions, and every other organization. save and except rei igious, charitable or educational. organizations, authorized under the laws of the State of Texas, to own and operate, for profit, any poo I or bill i ard tab Ie or tab les, as such terms are herein defined, within the municipal limits of the City of San Marcos without having first obtained an appropriate permit from the City Counci I which shall at all times be display- ed in some conspicuous place in the place of business. SECTION III. APPLICATION FOR PERMIT; Application shall be msde as a prerequisite to obtaining a permit. Such application shal I be fi led with the City Secretary and shal I set forth: (I) Name and address of the applicant and the name and address of any and al I persons having an interest, financial or otherwise, in the business; (2) The name under which the applicant does or proposes to do business; (3) The number of bi I I iard tables to be licensed; (4) The location of the establ ishment where billiard tables wi I I be operated for profit; (5) Whether or not appl icant has been convicted of a felony; (6) The need for additional billiard tables within the City; and, (7) Such other information as may be required by the City of San Marcos.
