<br />AN ORDINANCE MAKING IT MANDATORY THAT BEFORE THE CITY OF
<br />SAN MARCOS, TEXAS, SHALL BE LIABLE FOR DAMAGES TO ANY PER-
<br />SON OR PROPERTY, VERIFIED NOTICE OF ANY SUCH CLAIM SHALL
<br />FIRST BE GIVEN TO THE CITY OF SAN MARCOS WITHIN SIXTY
<br />(60) DAYS AFTER SUCH DAMAGES HAVE BEEN SUSTAINED, SUCH
<br />NOTICE TO SET OUT ALL PERTINENT FACTS IN CONNECTION WITH
<br />ANY SUCH CLAIM, WITH FAILURE TO SO NOTIFY THE CITY OF SAN
<br />MARCOS TO RESULT IN EXONERATION OF THE CITY OF SAN MARCOS
<br />FROM ANY LIABILITY WrlATSOEVER IN CONNECTION WITH SUCH
<br />CLAIM.

<br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS:

<br />
<br />That before the City of San Marcos, Texas, shall be liable for
<br />damages for accidental death, personal injuries of any kind, or for
<br />damage to or destruction of property of any kind, the survivor or sur-
<br />vivors in a death claim, or the person or persons injured, or the owner
<br />or owners of the property so damaged or destroyed, or some one in
<br />his or their behalf, shall give the City of San Marcos notice in writing,
<br />addressed to the Mayor or City Council of the City of San Marcos, of
<br />such death, injury, dMaage or destruction, duly verified, within sixty
<br />(60) days after the same has been sustained, stating in such notice
<br />when, where, and how the death, injury, damage or destruction occurred,
<br />the apparent extent of any such injury, damage or destruction, the
<br />amount of the damages sustained, the amount for which the claimant
<br />or claimants will settly, the street and residence numbers of the
<br />claimant or claimants at the time and date the claim is presented,
<br />the actual residence or residences of the claimant or claimants for the
<br />six months period of time immediately preceding the occurrence of such
<br />death, injury, damage or destruction, and the names and addresses
<br />of the witnesses upon whom the claimant or clailnants relies or
<br />rely to establish the claim; and a failure to so notify the Mayor or
<br />City Council within the time and manner herein provided shall fully
<br />exonerate, excuse and except the City of San Marcos, Texas, from any
<br />liability whatsoever in connection with any such claim.
