<br />regular meeting, apri I 12, 1966 <br /> <br />page three <br /> <br />I <br /> <br />the River, swimming In the headwaters lake, and keeping <br />the resort area free of undue amounts of aquatic plants. <br />The Mayor read a letter dated Jan.20, 1966, in which the <br />City Attorney gave an opinion on Mr. Stokes' problem, see <br />attached. Mr. Stokes asked the Mayor: "Does this mean <br />you are not franchising Aquarena to cut grass?" The Mayor <br />replied: "Not to my knowl~dge". <br />Mr, Wi II is aga i n took the floor for support i ng statements <br />in reference to his recommendation to the Counci I that it <br />pass an ordinance designating a portion of Spring Lake for <br />swimming and scuba diving. Alderman Froh asked how the <br />divers proposed to enter such an area, when all the property <br />along the River at that point is privately owned. Mr. Wi !lis <br />repl ied: "The river bottom belongs to the State... we would <br />go up the River..." <br />The Mayor read aloud a letter from the San Marcos Industrial <br />Foundation with a resolution favoring protection for Aquarena. <br />It was signed by J.R. Thornton and R.J. Pollard. B.R. Gulledge, <br />President of the Hays County Industrial Foundation, took the <br />floor to endorse the SM Industrial Foundation Resolution. <br />John Stokes, a director in the HC Industrial Foundation, <br />also endorsed the Resolution. Jack Mann, Senior at SWTSC, <br />said. he had been scuba diving in Spring Lake for four <br />years, and that every year more divers come to the Lake. <br />He questioned whether Aquarena really made less money the <br />past year, as stated by Mr. Clark. Mr. Clark replied that <br />in the past year, Aquarena had made less than it had in four <br />years. Alderman Whittenberg said: "It would take the wisdom <br />of Solomon to settle this to the satisfaction .of everyone. <br />I move we have no further discussion on this matter at this <br />time". Alderman Damon seconded the motion. The Mayor said <br />the matter would be referred to the City Attorney, adding: <br />"This Council is not going to get involved in a lawsuit". <br />After further discussion, the question being called for, the <br />following vote was recorded: <br /> <br />I <br /> <br />AYE: <br />NAY: <br /> <br />Damon, Froh, Pool, Korff, Whittenberg <br />None <br /> <br />The Mayor declared the motion carried. <br /> <br />R.A. Mosse, representative. of MKT Railway, came before the <br />Counci I to discuss the City's request for signal lights at <br />the rai Iroad crossings within the City Limits. Mr. Mosse <br />said the Highway Department did not request lights at the RM 12 <br />extension into San Marcos. He said he would report the re- <br />quest:: to his super i ors. <br /> <br />Alderman Damon moved that the City contact the State Highway <br />Department about. the signal lights. Al.derman Froh seconded <br />the motion and on 1'01 I cal I, the following vote was recorded: <br /> <br />I <br /> <br />AYE: <br />NAY: <br /> <br />Damon, Froh, Pool, Korff, Whittenberg <br />None <br /> <br />The Mayor declared the motion carried. <br /> <br />Alderman Damon introduced an Ordinance Naming City Officials <br />and moved its adoption. The Ordinance, made a part of the <br />Minutes, was read aloud. Alderman Froh seconded the motion <br />and on roll cal I, the fol lowing vote was recorded: <br /> <br />AYE: <br />NAY: <br /> <br />Damon, Froh, Pool, Korff, Whittenberg <br />None <br /> <br />The Mayor declared the Ordinance Passed, Approved and Adopted. <br />
