Walker
Kyle and Walke~
Attorneys at Law .
First National Bank Building'
San Marcos, Texas

'\.

Dear Albert:

This is in reply to your letter of February 6, 1967. Apparently'
I did not make clear the position of the LCRA. As I pointed out, the
LCRA in my opinion does nat need a franchise but that if one was needed
it has acquired the one passed by an ardinance adopted by the Cny of
San Marcas on June 4, 1925, which is valid for a period of fifty years. "

The proposed agreement was a method which we thought
would support the discount offered. The Board of LCR,A has approved
the proposed form of agreement as submitted to San Marcos, Kerrville,
and San Saba, and each of such cities can determine whether it desires
to accept the proposal and receive the benefits made available there-
under. The agreement has been accepted by San Saba and returned to
LCRA.

As we pointed out, under the agreement nothing but benefits
accrue to each city; however, if the city feels that the benefit offered
is not desired such is entirely a matter for decisian by the city.

If San Marcos at any time desires to terminate the agreement
<;r.e:). it can do so by notifying LCRA that it no longer desires to accept
;;~",e benefits provided by the agreement ar.d prefers that the agreement
be terminated at the end of ten years from the date the notice is given.

~.
