<br />AN ORDINANCE RECEIVING CERTAIN TERRITORY
<br />ADJOINING THE CITY LIMITS OF THE CITY OF
<br />SAN MARCOS, TEXAS, INTO SAID CITY
<br />

<br />WHEREAS, the owners of a strip of land, said strip of land not
<br />exceeding one-half (~) mile in width, being contiguous and
<br />adjacent to the present residents, qualified to vote for mem-
<br />bers of the State Legislature, have petitioned the City of
<br />San Marcos to annex said strip of land within the municipal
<br />limits, a copy of said petition being hereto attached, marked
<br />"Exhibit A", and made a part hereof for all pertinent purposes;
<br />and,
<br />
<br />WHEREAS, it will be of signal advantage to the City of San
<br />Marcos to annex said strip of land within its municipal limits:
<br />
<br />NOW, THEREFORE, BE IT ORDAINED by the City Council of the City
<br />of San Marcos,/ Texas, that the said strip of land, hereinafter
<br />described by metes and bounds, be and the same hereby is re-
<br />ceived as a part of the City of San Marcos, and the corporate
<br />limits of the City of San Marcos are hereby extended so as to
<br />include said strip of land, and from henceforth the territory
<br />so received and annexed shall be a part of the City of San
<br />Marcos, and shall be bound by the acts and ordinances of said
<br />City, in accordance with law.

<br />SAID STRIP OF LAND is described as:

<br />TRACT ONE: Beginning at an old iron pipe in an old fence
<br />for the Southeast line of a tract of land conveyed by
<br />Orin A. Harryman, et ux., to C. C. Hughson by deed of date
<br />November 3, 1950, and of record in Volume 148, pages 139-
<br />44 of the Deed Records of Hays County, Texas, and the most
<br />Western corner of a small strip of land conveyed by Arthur
<br />Newton Smith, et ux./ to the City of San Marcos, Texas, by
<br />deed of date June 12, 1963, and of record in Volume 197,
<br />pages 14-15 of .the Deed Records of Hays County, Texas, and
<br />the most Northern corner of a tract of land conveyed by
<br />Arthur Newton Smith, et ux., to Norman H. Schulle by deed
<br />of date December 24, 1952, and of record in Volume 155,
<br />pages 252-53 of the Deed Records of Hays County, Texas,
<br />and. the most Northern corner of a tract of land conveyed
<br />by Everett Johnson, et ux., to Ben H. Festervan by deed
<br />of date October 9, 1964, <>.ndof record in Volume 202, pages
<br />566-69 of the Deed Records of Hays County, Texas, and from
<br />the beginning corner an Elm tree, 7 inches in diameter,
<br />marked X, bears S. 280 32' W. 12.0 feet and another Elm
<br />tree, 4-inches in diameter, marked X, bears S. 380 20' E.
<br />31.5 feet and an old iron pipe, with its bearing trees,
<br />at the most Northern corner of the original Smith's tract
<br />of land bears N. 450 05' E. 162.1 feet;

<br />Thence with the old wire fence on the Southeast line of
<br />the Hughson's tract of land and the northwest line of the
<br />Festervan's tract of land, S. 450 OS' W. 162.1 feet to an
<br />iron pipe for the most Western corner and an old corner
<br />fencepost bears S. 45005' W. 10.6 feet;

<br />Thence S. 45032' E. 335.9 feet to a concrete monument at
<br />the most Western corner of a 33-foot Road easement for the
<br />most Southern corner and an iron pipe at the most Western
<br />corner of a small tract of land conveyed by Bryan Baldridge,
<br />et ux., to Ben H. Festervan by deed of date October 3, 19.61,
<br />and of record in Volume 188, page 261 of the Deed Records
<br />of Hays County, Texas, bears S. 450 32' E. 50.0 feet;
