I I I RES 0 L UTI 0 N A RESOLUTION AUTHORIZING THE EXCHANGE OF TRACTS OF LAND BY AND BETWEEN THE CITY OF SAN MARCOS ON THE ONE HAND AND THE SAN MARCOS BAPTIST ACADEMY ON THE OTHER, SUCH EXCHANGE TO INVOLVE NO ADDITIONAL CONSIDERATION OTHER THAN SUCH TRACTS THEMSELVES, TO BE CONSUMMATED AT THE EARLIEST PRACTICABLE DATE AND TO BE SUBJECT TO RESERVATION IN CITY OF SAN MARCOS OF USE OF AND ACCESS TO WATER RESERVOIR. I. BE IT RESOLVED by the City Council of the City of San Marcos that the City of San Marcos exchange with the San Marcos Baptist Academy the two (2) tracts of land owned by the City of San Marcos, herein called "FIRST TRACT" and "SECOND TRACT", for the tract of land, herein called "THIRD TRACT", owned by the San Marcos Baptist Academy; that such exchange shall be of land for land, that is, of two tracts for the other tract, and neither party shall pay to the other any money or other valuable consideration; that such exchange shall be consummated at the earliest practicable date; that the City of San Marcos shall reserve in the deed from it covering FIRST TRACT and SECOND TRACT full rights of use and access to the water reservoir presently located upon the said FIRST TRACT for a period of five (5) years from the date of such exchange, or until the completion by the City of San Marcos of a water reservoir upon said THIRD TRACT, whichever event first occurs. II. BE IT FURTHER RESOLVED that Ellis Serur, Mayor of the City of San Marcos, a municipal corporation, be, and he is hereby autho- rized and directed to execute, acknowledge and deliver the deed of conveyance to the San Marcos Baptist Academy of the said FIRST TRACT and SECOND TRACT, and to accept delivery from the San Marcos
