<br />31. <br /> <br />Regular meeting <br /> <br />March 22, 2004 <br /> <br />Page 3 <br /> <br />SINGLE-FAMILY DWELLING DISTRICT (LOW DENSITY); INCLIDING PROCEDURAL <br />PROVISIONS; AND PROVIDING FOR PENALTIES. <br /> <br />Mayor Habingreither opened the public hearing and asked if anyone wished <br />to speak. No one did, so Mayor Habingreither closed the public hearing. <br />Ms. Narvaiz moved for adoption of the Zoning Ordinance, and Mr. Diaz <br />seconded the motion, which passed unanimously. <br /> <br />Mayor Habingreither introduced for consideration a public hearing and <br />approval of an Ordinance on first reading, the caption which was read as <br />follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />RENEWING THE EXISTING FRANCHISE AGREEMENT BETWEEN THE CITY AND THE <br />BLUEBONNET ELECTRIC COOPERATIVE, INC. FOR A PERIOD OF FIVE YEARS; <br />AMENDING THE AGREEMENT TO PROVIDE FOR AUTOMATIC RENEWAL OF THE <br />AGREEMENT FOR FIVE YEAR PERIODS; PROVIDING FOR WRITTEN ACCEPTANCE TO <br />BE FILLED BY THE BLUEBONNET ELECTRIC COOPERATIVE, INC;-AND PROVIDING <br />AN EFFECTIVE DATE. <br /> <br />Mayor Habingreither opened the public hearing and asked if anyone wished <br />to speak. No one did, so Mayor Habingreither closed the public hearing. <br />Ms. Narvaiz moved for approval of the Ordinance on first reading and Mr. <br />Taylor seconded the motion. Mr. O'Leary stated the original Ordinance <br />authorizes Bluebonnet to construct and maintain its electric distribution <br />facilities in City rights-of-way and utility easements, requires <br />Bluebonnet to comply with standards and regulations for use of City <br />property, and requires Bluebonnet to pay a franchise fee to the City of 3% <br />of its gross revenues from electric sales in the city limits. He also <br />stated the attached Ordinance would renew the franchise for a period of <br />five years. The Council then voted unanimously for approval of the <br />Ordinance on first reading (Mr. Taylor was not present in the Chambers for <br />this vote) . <br /> <br />Mayor Habingreither introduced for consideration a public hearing and <br />approval of the Budget Policy Statement to be used by the City Manager as <br />direction during the preparation of the proposed FY2004-2005 Budget. <br />Mayor Habingreither opened the public hearing and asked if anyone wished <br />to speak. No one did, so he closed the public hearing. Mr. Montoya moved <br />for approval of the Budget Policy Statement and Ms. Narvaiz seconded the <br />motion. Ms. Narvaiz stated last year the Council changed the Hotel/Motel <br />Tax allocations to a percentage. She stated the Council has chosen to <br />continue with this same percentage allocation. Mr. Thomaides stated he <br />appreciates the conservative efforts of the Council regarding the budget. <br />He stated this budget will be a challenge to fund CIP projects without <br />raising taxes. Mr. O'Leary stated the Budget Policy Statement will be <br />used to develop the budget and will be posted on the City website. The <br />Council then voted unanimously for approval of the Budget Policy Statement <br />to be used by the City Manager as direction during the preparation of the <br />proposed FY2004-2005 Budget, a copy of which is attached to these minutes. <br />
