J" RESOLUTION A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS AUTHORIZING THE CITY MANAGER TO BRING SUIT AGAINST THE OWNERS OF LAND HEREIN DESCRIBED TO ACQUIRE SEWAGE mSPOSAL LINE EASEMENTS I WHEREAS, the City Council of the City of San Marcos has found and determined that public necessity requires the construction of ase~ge disposal line within and adjacent to the City of San Marcos, and particularly in the vicinity of Porter Street, to provide for the diposal of sewage accumulating on properties in and around the City of San Marcos; and, WHEREAS, the City Council has found and determined that public necessity requires the acquisition of a perpetual easement ten (10) feet in width across the hereinafter described tract of land for a right-of-way to permit the construction and maintenance of the I aforesaid sewage disposal line; WHEREAS, the City Council has found and determined that public necessity also requires the acquisition of two temporary working space easements of ten (10) feet each in width immediately adjacent to and on both sides of said permanent easement, to cover the period of original installation of said sewage disposal line; and, WHEREAS, the City of San Marcos has negotiated with the owners of said land and has been unable to agree with such owners as to the fair cash market value of such easements; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CIny OF SAN MARCOS, TEXAS: I That the City Manager of the City of San Marcos be and he is hereby authorized and directed to file or cause to be filed against all owners and lien holders, a suit in eminent domain to acquire the perpetual easement, hereinafter described by metes and bounds, for construction and maintenance of said sewage disposal line, and to further acquire said ten (10) foot wide temporary working space easements immediately adjacent to and on both long sid,es of said perpetual easement: -1-
