<br />~ <br /> <br />THE STATE OF TEXAS <br /> <br />LEASE <br /> <br />COUNTY OF CALDWELL <br /> <br />KNOW ALL MEN BY THESE PRESENTS: <br /> <br />That the City of San Marcos, Texas, a municipal corporation <br /> <br />I <br /> <br />existing by and under the laws of the State of Texas, acting thvough <br /> <br />authority conferred on its Mayo~ John A. Hansen, by Resolution 79- <br /> <br />, adopted December 27, 1979, hereinafter "City", and Butternut <br /> <br />Electronics Company, hereinafter "Compilny" enter into this lease of <br /> <br />a portion of the San Marcos Municipal Airport. <br /> <br />WITNESSETH <br />I. <br /> <br />City is the owner of the San Marcos Municipal Airport by virtue <br /> <br />of an indenture from the United States of America dated the 14th day <br /> <br />of February, 1966, the 14th day of July, 1969, and the 11th day of <br /> <br />May, 1976, to which reference is hereby made and by such reference, <br /> <br />I <br />II <br />I <br /> <br />made a part thereof. City hereby leases unto Company a portion of said <br /> <br />Airport for the purpose of manufacturingartdcselling radio antennas. <br /> <br />City hereby leases and Company hereby rents the premises on which is <br /> <br />located building No. 6-356, said building containing approximately <br /> <br />3,520 square feet of floor space. Company agrees to have an exact <br /> <br />survey made of said premises, and both parties agree that the survey <br /> <br />shall be made a part of this lease. <br /> <br />II. <br /> <br />As consideration and rental for the demised premises, Company <br /> <br />agrees to pay to City the sum of five cents (59) per square foot per <br /> <br />year. Payment shall be made in advance. The first payment shall be <br /> <br />made on the date of execution of this lease by Company. Subsequent <br /> <br />payment shall be made one year from the date of the first payment. <br /> <br />I <br /> <br />I <br /> <br />III. <br /> <br />CQmpan~ agrees to use said premises for manufacturing and selling <br /> <br />radio antennas. Company agrees to make necessary repairs on said <br /> <br />building No. 6-356 to bring said building up to condition equal to <br /> <br />the building located between the T-hangars and the large maintenance <br /> <br />hangar. All improvements and alterations made by Company on said <br /> <br />J <br />
