~ THE STATE OF TEXAS LEASE COUNTY OF CALDWELL KNOW ALL MEN BY THESE PRESENTS: That the City of San Marcos, Texas, a municipal corporation I existing by and under the laws of the State of Texas, acting thvough authority conferred on its Mayo~ John A. Hansen, by Resolution 79- , adopted December 27, 1979, hereinafter "City", and Butternut Electronics Company, hereinafter "Compilny" enter into this lease of a portion of the San Marcos Municipal Airport. WITNESSETH I. City is the owner of the San Marcos Municipal Airport by virtue of an indenture from the United States of America dated the 14th day of February, 1966, the 14th day of July, 1969, and the 11th day of May, 1976, to which reference is hereby made and by such reference, I II I made a part thereof. City hereby leases unto Company a portion of said Airport for the purpose of manufacturingartdcselling radio antennas. City hereby leases and Company hereby rents the premises on which is located building No. 6-356, said building containing approximately 3,520 square feet of floor space. Company agrees to have an exact survey made of said premises, and both parties agree that the survey shall be made a part of this lease. II. As consideration and rental for the demised premises, Company agrees to pay to City the sum of five cents (59) per square foot per year. Payment shall be made in advance. The first payment shall be made on the date of execution of this lease by Company. Subsequent payment shall be made one year from the date of the first payment. I I III. CQmpan~ agrees to use said premises for manufacturing and selling radio antennas. Company agrees to make necessary repairs on said building No. 6-356 to bring said building up to condition equal to the building located between the T-hangars and the large maintenance hangar.
