<br />~ <br /> <br />46,- <br /> <br />responsibility of the cemetery or the City of San Marcos ceases; <br /> <br /> <br />and disposal will be made of the same as the Caretaker deems <br /> <br /> <br />advisable. Vaults, tombs, sarcophaguses, mausoleums (except that <br /> <br /> <br />mausoleum presently owned by the City), or like structures are <br /> <br /> <br />expressly prohibited. The vault hereinbefore named does not con- <br /> <br /> <br />template the underground vault customarily used to encase a casket. <br /> <br />I <br /> <br />6. ROADWAYS AND REPLATTING. <br />A. The right to enlarge, reduce, replat and/or change the <br />boundaries or grading of the cemetery or of a section or sections, <br />from time to time, including the right to modify and/or change the <br /> <br />locations of or remove or regrade roads, drives, and/or walks, or <br /> <br /> <br />any part thereof, is hereby expressly reserved to the City. The <br /> <br /> <br />right to lay, maintain and operate or alter or change pipelines <br /> <br /> <br />and/or gutters for sprinkling systems, drainage, is also expressly <br /> <br /> <br />reserved to the City; as well as is the right to use cemetery <br /> <br /> <br />property, not sold to individual lot or grave space owners, for <br /> <br /> <br />cemetery purposes, including the interring and preparing for <br /> <br /> <br />interment of dead human bodies, or for anything necessary, <br /> <br /> <br />incidental or convenient thereto. The City reserves for itself, <br /> <br /> <br />and to those lawfully entitled thereto, a perpetual right to ingress <br /> <br /> <br />and egress over lots for the purpose of passage to or from other lots. <br /> <br /> <br />No easement or right of interment is granted to any lot owner in any <br /> <br /> <br />road, drive or walk may be used as a means of access to the Cemetery <br /> <br /> <br />or buildings as the City devotes to that purpose. The Cemetery <br /> <br /> <br />Caretaker, with the permission of the City Manager, shall have the <br /> <br /> <br />right, at any time, to close any road, drive or walk. <br /> <br />I <br /> <br />B. It shall be unlawful for any person or persons to ride or drive <br />any vehicle upon, over or across the lands or lots of this cemetery, <br />except the regularly laid-out vehicle ways in said cemetery; however, <br />this provision is not intended to include the operation of mowing <br />vehicles used by employees or agents of the City in the maintenance <br />of the cemetery grounds, or vehicles necessary to transport machinery <br />essential in the opening and closing of grave spaces and/or other <br />maintenance incidental to that operation. <br /> <br />7. PERPETUAL CARE. <br />A. Every purchaser of a lot in a cemetery owned by the City shall <br /> <br />be required, in addition to the payment of the price fixed for said <br />
