<br />-5- <br /> <br />I <br /> <br />(2) The application shall be expediously reviewed <br />by the appropriate City officials to ensure <br />compliance with all designated conditions. <br />(3) Upon completion of the review process, the <br />Zoning Administrator shall either approve or <br />deny said application. <br />A. Upon approval, the applicant shall submit <br />his application papers to the City <br />Secretary for appropriate certification. <br />B. Upon denial, <br />1. Applicant then shall have a reasonable <br />time, not to exceed thirty (30) <br />days, in which to correct any deficiencies" <br />which were the basis for denial, to <br />the satisfaction of reviewing officials <br />and the Zoning Administrator. <br />2. The applicant shall have the right to <br />appeal said denial to the Zoning Board <br />of Adjustment. The decision of said <br />Board shall be final unless overturned <br />by a court of competent jurisdiction. <br />(E) Conditional Use Permits may be issued for the <br />use of property zoned 'C' Commercial only for <br />establishments which dispense liquor, wine, or <br />beer for on-premise consumption under permit by <br />the State of Texas upon compliance with the <br />following conditions: <br />(1) The place of said business is not located <br />within three hundred (300 ) feet of an existing <br />building which in its entirety or in a portion <br />thereof, is arranged, occupied, or intended to <br />be occupied as living quarters by. one or more <br />persons for a period of thirty (30) days or <br />longer.
