20. Public Hearing to receive comments for and against an ordinance approving an <br />amendment to the future land use map from "VLDR" Very Low Density Residential to • <br />"MU" Mixed Use for a 10.65 acre, more or less, tract of land out of the Thomas J <br />Chambers Survey Abstract No. 2; and including procedural provisions; and consider <br />Ordinance 2010 -29. <br />Mayor Narvaiz opened the Public Hearing at 8:04 p.m. <br />Steve Ramsey, 3206 Yellowpine, Austin, spoke on behalf of Craddock Avenue Partners. Median <br />improvements will benefit area residents. He reported they have requested a reduction of 2.23 <br />acre because the owner wants to work more with the neighbors. <br />Anita Fuller, 121 Kathryn Cove, stated that she is in favor of the land use and zoning change. <br />She noted that Franklin Street already has property designated with a Mixed use District, a <br />General Commercial District, a Light Industrial District, as well as Single Family. On North <br />Bishop there is a Mixed Use District, two Neighborhood Commercial Districts and a Townhouse <br />Residential District. She believes that the requested Mixed Use District will complement and <br />enhance the zoning already in place on Franklin and North Bishop. She is assured that the <br />development agreement with the City will be developed in a manner observing all policies, rules <br />and ordinances required by the City. The TCEQ report gives her further assurance that the <br />environmental issues will be addressed when developing the property. She welcomes the type of <br />development that will potentially provide businesses within walking distance. She believes it is <br />time for the City to embrace life -style centers and allow small "mom and pop" type businesses to <br />be included in neighborhoods. • <br />John McBride, 703 Franklin, stated that he has lived there for 35 years. He is concerned this will <br />lead to the development of 300 plus apartments. Opponents to this development have been <br />portrayed as anti - growth. That is not true, but he thinks the vote taken last time is confirmation <br />that the master plan and the work the citizens did is not worth the paper it is written on. The only <br />protection they have is to put new people on the dais. <br />Diana Wassenich, 11 Tanglewood, representing the San Marcos River Foundation, stated the <br />City should wait to move forward until the items found missing are included in the GA. Their <br />research found a complex of nine faults, along with a major fault not shown on GA. There is <br />still a problem of a missing cave, and caves were covered up by bulldozing and clearing. They <br />contacted the geologist who said they should use his coordinates. They have requested TCEQ to <br />review all the GA's. <br />Joe Schneider, 803 Mustang Lane, showed a notice he received on May 15. He said that he <br />asked for the names and mailing addresses inside the 200' zone. He noted that on Friday the <br />developer pulled out 2.23 acres and disenfranchised some property owners. A 50' buffer zone is <br />not sufficient. He stated the rules were changed in the eleventh hour. He told the Council that if <br />they feel this is the right thing to do, then they should vote approval.
