Ed Theriot, stated that the Mixed Use district is the most appropriate. <br />• Planning and Zoning reiterated that fact last Tuesday. This request is consistent with much of <br />the light industrial already located along Franklin. Planning and Zoning also recognized that the <br />development agreement includes additional standards such as a PDD light requirement. This is <br />being designed in a manner to achieve a walkable neighborhood character. They have worked <br />closely with the planning staff, and the application is consistent with the Horizons Master Plan <br />and the Sector 2 plan. The property owners have gone above and beyond, and their efforts have <br />been recognized by the Planning and Zoning and City staff. He requested that Council consider <br />support of these well considered recommendations. <br />Kevin Carswell, stated his support of the Buie tract. Further development <br />will help the tax base and the school district. <br />Pam Kimrey, stated her support of the Buie tract and smart growth. She has <br />seen the neighborhood go through several developers and feels this would be an asset to <br />community and would enhance the Westover area. She reported that when she was approached <br />to sign the petition, she believes it was misrepresented, and after conducting some research, she <br />had her name withdrawn. <br />Casey Couch, informed the Council there is nothing for young professionals in <br />San Marcos. However, when you build a community within a community, like with this project, <br />then you have a neighbor to neighbor feel. <br />• Camille Phillips, asked the Council to reject this zoning. She said she was <br />surprised to learn that a zoning request can be changed so late in the process. She asked if <br />people know that the Buie developers do not believe in cleaning up after themselves. When the <br />property was cleared, the City paid to remove the debris. Also, the development agreement was <br />to be filed with the County, and when she went to the Hays County Records Office no one could <br />locate the document. <br />Pam Couch, read a letter from a local small business that stated this is one of <br />the few places that lacks convenience in the area. Having centralized services in neighborhoods <br />will be beneficial to the growing number of people moving to the area. After reading the letter, <br />she noted that the plan is not the Bible. It is a fluid document and a blueprint to follow. When <br />business calls for you to change your plan, then you had better change that plan. <br />There being no further comments, the Public Hearing was closed at 8:29 p.m. <br />MOTION: Upon a motion made by Councilmember Porterfield and a second by <br />Councilmember Jones, the City Council voted five (5) for and two (2) opposed, with <br />Councilmembers Bose and Thomaides voting against, to adopt Ordinance 2010 -29, as previously <br />captioned. The motion carried. <br />21. Public Hearing to receive comments for and against an ordinance amending the official <br />• zoning map of the City by rezoning a 12.88 acre, more or less, tract of land out of the <br />Thomas J.
