<br />123-b <br /> <br />I <br /> <br />3. 'PURCHASE OF LOTS OR MAUSOLEUM CRYPTS . Cemetery lots or mausoleum <br />crypts may be purchased in the Office of the City Secretary where <br />plats showing the size, location and description of all lots and the <br />schedule of prices will be kept on file. Cemetery lots will be <br />selected exclusively at the Cemetery. Deeds for any burial space will <br />not be delivered to any purchaser until the purchase price of the <br />same and the cost of perpetual care has been paid to the Finance <br />Director in full. Persons desiring to acquire multiple grave spaces <br />in the cemetery and not being able to pay the entire price thereof <br />may reserve same for a period not to exceed 180 days. The City <br />reserves the right to refuse interment on any lot for which the full <br />purchase price, including perpetual care, has not been paid. All <br />deeds shall grant to the lot or crypt owner or owners the right to <br />use such lots or crypts for interment of human remains only, subject <br />to provisions of these rules and regulations. <br /> <br />I <br /> <br />4. TRANSFER OR ASSIGNMENTS. No transfer or assignment of any lot, <br />or interest therein, shall be valid without the consent in writing <br />of the City to be had and endorsed upon such transfer or assignment, <br />and thereafter being recorded on the books of the City. The City <br />shall have the right to refuse to consent to a transfer or an assign- <br />ment as long as there is any indebtedness due the City by the owner <br />of record. <br /> <br />I <br /> <br />S. REPURCHASE BY THE CITY. If for any reason it becomes necessary <br />for any lot owner to dispose of his or her interest in or title to <br />any cemetery lot or mausoleum crypt, application may be made in the <br />Office of the Finance Director for repurchase of said interest in or <br />title to such lot by the City which may elect to'repurchase the lot <br />or crypt at a price equal to the current price set by the City for the <br />repurchase of lots. The payment price will be made to the lot owner <br />when he or she has conveyed to the City of San Marcos by deed a good <br />and sufficient title. If and when the City shall elect to repurchase <br />a lot not already having perpetual care, the City shall include the <br />cost of perpetual care in the selling price of said lot before again <br />offering it for sale. <br /> <br />-2- <br /> <br />~ <br />
