92 Regular Meeting June 22, 1981 Page 2 Mr. Cavazos introduced for consideration an emergency Ordinance, the caption which was read as follows, but which was read in its entirety: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, ORDERING A SPECIAL ELECTION ON AUGUST 8, 1981, FOR THE PURPOSES OF ELECTING A MAYOR OF SAID CITY AND SUBMITTING AMENDMENTS TO THE CHARTER OF SAID CITY; MAKING PROVISIONS FOR THE CONDUCT OF THE ELECTION AND DECLARING AN EMERGENCY. Mrs. Norris moved to adopt the Ordinance and Mr. Kreczmer seconded the motion, which passed unanimously. Mr. Cavazos introduced for consideration adoption of a Resolution, the caption which was read as follows: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, APPROVING THE SAN MARCOS CEMETERY RULES AND REGULATIONS AND DECLARING AN EFFECTIVE DATE. In the Council discussion Mr. Kreczmer indicated he opposed the 18" curbing. Mr. Kreczmer moved that Section 7 pertaining to Curbing in the San Marcos Cemetery Rules and Regulations be amended to a 6" curb, 3" within the owner's property lines and 3" in the City's easement. There was no second and the motion died. Mrs. Norris moved to adopt the Rules and Regulations for the San Marcos Cemetery (as submitted) and Mrs. Mendez seconded the motion. On roll call the following vote was recorded: AYE: Brown, Cavazos, Mendez and Norris. NAY: Kreczmer. ABSTAIN: None. Mr. Cavazos introduced for consideration on first r~ading an Ordinance, the caption which was read as follows, but which was read in its entire- ty: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING CHAPTER 6, ENTITLED "CEMETERIES" OF THE CODE OF ORDINANCES, CITY OF SAN MARCOS, TO INCREASE PERMIT FEES FOR WORK PERFORMED AT THE SAN MARCOS CEMETERY; TO SET OTHER FEES; TO INCREASE FEES FOR THE PURCHASE OF PERPETUAL CARE AT THE SAN MARCOS CEMETERY AND DECLARING AN EFFECTIVE DATE. Mrs. Norris moved to approve the Ordinance on first reading and Mr. Kreczmer seconded the motion, which passed unanimously. Mr. Cavazos introduced for consideration the approval of expiration or extension of the 90-day moratorium on high density development over the Recharge Zone. Chairman Joel Bernard stated that the Plan- ning and Zoning Commission recommended the extension of the moratorium for a period of 90 days and stated they also recommended the incorpora- tion of the standards set out in Joe Garza's memorandum of June 19, 1981 attached to these minutes as a guideline during ~he moratorium. Mrs. Norris moved that the Staff create an Interim Ordinance incor- porating the standards set out in Joe Garza's memorandum until the Environmental Ordinance Committee could create an Ordinance to be submitted to Council for approval and adoption and Mr. Cavazos se- conded the motion. On roll call the following vote was recorded: AYE: Cavazos, Mendez and Norris. NAY: Brown and Kreczmer. ABSTAIN: None. The motion failed.
