107 <br /> <br />Special Meeting <br /> <br />July 6, 1981 <br /> <br />Page 4 <br /> <br />AYE: Brown, James and Kreczmer. <br /> <br />NAY: Cavazos, Mendez and Norris. <br /> <br />ABSTAIN: None. <br /> <br />The motion failed. <br /> <br />Mr. Brown then moved for the new Proposition No. 7 - Cemetery <br />($100,000) be placed on the bond program and Mr. Kreczmer seconded <br />the motion. On roll call the following vote was recorded: <br /> <br />AYE: Brown, James, Kreczmer and Mendez. <br /> <br />NAY: Cavazos and Norris. <br /> <br />ABSTAIN: None. <br /> <br />The motion passed. <br /> <br />The Council then moved back to Proposition No. 4 - Flood Damaged <br />Streets ($365,000) to be placed on the bond program. Mr. Br~wn <br />moved that Proposition No. 4 be placed on the bond program and Mrs. <br />Norris seconded the motion. On roll call the following vote was re- <br />corded: <br /> <br />AYE: Brown, James, Kreczmer, Mendez and Norris. <br /> <br />NAY: Cavazos. <br /> <br />ABSTAIN: None. <br /> <br />The motion passed. <br /> <br />Mr. Curtis Adrian then addressed the Council as to the possibility <br />of Proposition No. 6 - Waterworks and Sewer System be placed on the <br />ballot as Proposition No. 1 so that the single Revenus ~Bond on the <br />ballot would not appear in between two General Obligation Bonds. <br />Mr. Brown moved that Mr. Adrian's suggestion be made and Mr. James <br />seconded the motion, which passed unanimously. <br /> <br />Staff was directed to place on the July 13 agenda the item as will <br />be prepared by Rick Fisher, for the City Bond Election. <br /> <br />Mr. James introduced for consideration the approval of a Resolution <br />approving an agreement with a surveyor for right-of-way easement on <br />Bishop Street, the caption which was read as follows: <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS, APPROVING THE TERMS AND CONDI- <br />TIONS OF AN AGREEMENT WITH DABNEY-BYRN AND ASSO- <br />CIATES FOR SURVEYING SERVICES IN CONNECTION WITH <br />THE PROVISION OF A STRIP RIGHT-OF-WAY MAP FOR <br />BISHOP STREET; AUTHORIZING THE CITY MANAGER OF <br />SAID CITY TO EXECUTE SAID AGREEMENT AND DECLARING <br />AN EFFECTIVE DATE. <br /> <br />Mr. Kreczmer moved to table this item until the July 13 meeting and <br />Mr. Cavazos seconded the motion, which passed unanimouSly. <br /> <br />Mr. Jalnes introduced for consideration authorization to retain spe- <br />cial counsel. Mr. Brown moved that Staff make recommendations of <br />three names, to include local and non-local counsel, pertaining to <br />the possible water rate increase and the pending litigation involving <br />the City and Planning and Zoning Commission, and present the names at <br />the July 13 meeting, and Mr. James seconded the motion.
