D. Construction Phase 4) -3- 5) 1) Make periodic visits to the site to observe as an ex- perienced and qualified design professional, the pro- gress and quality of the executed work and to deter- mine in general if the work is proceeding in accord- ance with the plans and specifications. Engineer shall not berequired to make exhaustive or continu- ous on-site inspections to check the quality or quantity of the work. Engineer shall not be respon- sible for the means, methods, techniques, sequences or procedures of construction selected by the con- tractor or the safety precautions and programs incident to the work of the contractor. Engineer's efforts will be directed towards providing assurance for the owner that the completed project will conform to the plans and specifications, but Engineer shall not be responsible for the failure of the contractor to perform the construction work in accordance with the plans and specifications and the contractor's contract, as long as Engineer shall report to the City any deficiencies in the work actually detected by Engineer. During such visits and on the basis of on- site observations, Engineer shall consult and advise with City during construction and submit to City periodic reports on progress of construction when such reports are requested by City. 2) Review and approve Shop Drawings (as that term is de- defined in the Standard General Conditions of the Construction Contract National Society of Professional Engineers document 1910-8, 1974 edition) and samples, the results of tests and inspections and other data which any contractor is required to submit, but only for conformance with the design concept of the Project and compliance with the information given in the contract documents; determine the acceptability of substitute materials and equipment proposed by contractor(s); and receive and review (for general content as required by the specifications) maintenance and operating instructions, schedules, guarantees, bonds and certificates of inspection which are to be assembled by Contractor(s) in accordance with the contract documents. 3) Review and approve in writing monthly and final esti- mates for payments to construction contractor and in this respect check the contractor's weekly p~yroll record for compliance with wage rate and category provisions of the contract by comparing payroll records with specification requirements if required to do so by City. Consult and advise City; issue all instructions to the contractor requested by City; and prepare routine change orders as required. Hold periodic conferences with the City or its represenative to the end that the project developed shall have full benefit of the City's experience and knowledge of the existing needs and facilities and be consistent with its current policies and standards.
