-5- Ce De After acceptance by City of the contract drawings and Engineer's most recent opinion of probable Project cost and upon written authorization to proceed, Engineer shall proceed with performance of the services called for in the Bidding Phase. This Phase shall terminate and the services to be rendered thereunder shall be considered cc~plete upon cc~nencement of the Construction Phase. The Construction Phase will co,~u~nce ~th execution of the contract and will terminate upon written approval by Engineer of final payment to the contractor(s). FailUre of Engineer to n~et the time requirements in,posed by sections A-D of this Article shall be grounds for immediate termination of this agreement by City. Be Vo O~mpensation The basic services described in Article II shall be paid for on the basis of percentage of the cons%ruction cost oft he project using~he curve shown as Attachment B, not %o exceed 10% on projects of greater than $50,000 construc- tion cost. The construction cost willbe %he lo~st reliable acceptable bid. Basic service fees for projects under $50,000 will be negotiated by the parties hereto. 1) Upon deliveryof the preliminary design, the Engineer shall be paid $12,900.00 for basic services plus all cc~pensation due for additional services rendered and reimbursable expenses incurred to that date. 2) The pro-rataportion of the fee paid for the Prelim- inaryPhase of the services willbe credited to those improvements authorized to be taken through the final design pb~se. 3) Upon delivery of the final design, the Engineer shall be paid an amount such that this amount plus the previous payment for basic services shall total 70% of the total compensation due for basic services, plus all cc~pe_nsation due for additional services rendered and reimbUrsable expenses incurred to that date. 4) Upon award of t~ c~ntract, the Engineer shallbepaid an amount such that this amount plus the previous pay- ment for basic services shall total 85% of the total conl3ensation due for basic services, plus all cc~pensa- tion due for additional.services rendered and reimburs- able expenses incurred to that date. 5) During the construction phase, the Engineer may su~ait monthly invoices based on .~he percentage 'of the contractor's completion of the project and for addi- tional services accc~plished during the billing period. Upon comPletion of the construction phase, the Engineer shall be paid the balance of the compensation due for basic services plus all compensation due for additional services rendered and reimbursable expenses incurred to that date.
