also develop recommendations for the replacement or future provision of spatial needs of the <br />City based on the City's projected growth. The completed Project will serve as a guide to: <br />• Provide a review of current space usage; <br />• Assess current and future space needs up to the year 2030 in 5 -year increments; <br />• Provide recommendations on the best use of the City's current facilities; <br />• Determine current and future site needs and parking requirements; <br />• Provide recommendations on the expansion/renovation of existing or the construction <br />of new facilities to meet the identified needs; and <br />• Provide projected costs for the implementation and phasing of the recommendations <br />developed as part of the facility needs assessment. <br />1.0.2 The Consultant's Basic Services consist of the services described in Sections 1.0 through <br />1.5. <br />1.0.3 The performance of all services by the Consultant in connection with this Agreement will <br />be by persons appropriately licensed or registered under State, local and Federal laws. The <br />Consultant represents that it engages in the business of providing facility planning services to <br />similarly structured municipalities, that it has the knowledge and experience required to <br />accomplish facility programming and planning projects as well as a unique understanding of the <br />character of this Project, and that it is qualified to provide master planning services to the City <br />for this Project. In performing all services under this Agreement, the Consultant will use that <br />degree of care and skill normally exercised for similar projects by Consultants who possess <br />special expertise in the types of services included in this Agreement. <br />1.0.4 The Consultant will not subcontract any work under this Agreement without prior written <br />approval from the City. The Consultant will specify any work or services subcontracted under <br />this Agreement by separate written Agreement(s) and those Agreement(s) will be subject to each <br />provision of this Agreement. <br />1.0.5 Any provisions in this Agreement pertaining to the City's review, approval and/or <br />acceptance of written materials prepared by the Consultant and/or its subconsultants, contractors, <br />and subcontractors in connection with this Agreement will not diminish the Consultant's <br />responsibility for the materials. <br />1.0.6 Consultant will perform all of its services in coordination with the City. The Consultant <br />will advise the City of data and information the Consultant needs to perform its services and the <br />Consultant will meet with City representatives at mutually convenient times to assemble this data <br />and information. <br />1.0.7 Doug Abraham is the Consultant's Project Representative assigned to this Project. The <br />Consultant will not substitute another representative for this project unless approved in writing <br />by the City in advance of such proposed substitution. In the event the City and the Consultant <br />cannot agree to the substitution of the Project Representative, the City may terminate this <br />agreement in accordance with Article 7. <br />Facility Needs Assessment Agreement Final <br />2 <br />
