164 <br /> <br />Regular Meeting <br /> <br />August 24, 1981 <br /> <br />Page 2 <br /> <br />Mayor Craddock opened the public hearing on property out of Farm Lot <br />No. 22 of the Original Town of San Marcos located in the 400 Block of <br />North Guadalupe Street on a zoning request that the property be rezoned <br />from "D" (Multi-Family Dwelling District) to "C" (Commercial District). <br />Mr. B. F.. Davidson, the developer of the property, stated the City <br />Council adopted an ordinance on May 24, 1970 rezoning the property <br />for commercial use, but neglected to prepare the ordinance, and the <br />City Attorney, Barbara Edwards, advised him it would need to go be- <br />fore the Council for consideration. Mr. John Stokes stated Mr. David- <br />son had erected a sign wherein the future use of the property would <br />be developed as a shopping center, creating a traffic problem on <br />Guadalupe as well as Fredericksburg, and that the owner of the pri- <br />vate road had not given Mr. Davidson access to the road. Mr. Davidson <br />stated the property was not adjacent to the private road and that the <br />sign had been t~ken down and he did not know what the future develop- <br />ment of the property would be, but that the development would be on <br />Guadalupe and not Fredericksburg. Mr. Stokes stated the narrowness <br />of Fredericksburg could not withstand more traffic and that the Council <br />needed to address a possible right-of-way easement with the developer <br />of the property to take care of additional traffic. No one else wished <br />to speak in favor or against the rezoning request. Mr. Cavazos then <br />moved for the tabling of this rezoning request until Staff had time <br />to address the traffic concerns and Mrs. Norris seconded the motion. <br />On roll call the following vote was recorded: <br /> <br />AYE: Brown, Cavazos, Craddock, Kreczmer, Mendez and Norris. <br /> <br />NAY: Jame s. <br /> <br />ABSTAIN: None. <br /> <br />Mayor Craddock introduced for consideration on first reading an Ordin- <br />ance abandoning part of the alley in Block 3 of the Westover Addition <br />to Robert C. Haney, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, ABANDONING, VACATING AND CLOSING A <br />PORTION OF AN ALLEY IN BLOCK 3 OF THE WESTOVER ADDI- <br />TION TO THE CITY OF SAN MARCOS, TEXAS; PROVIDING FOR <br />THE REVERSION OF FEE IN SAID LAND AND DECLARING AN <br />EFFECTIVE DATE. <br /> <br />Mrs. Norris once again requested an appraisal of the alley. During <br />a discussion Staff was instructed by the Council to get appraisals on <br />alleys prior to the Ordinances coming before the Council. Mrs. Norris <br />then moved to table this Ordinance until an appraisal of its value had <br />been made and Mr. Brown seconded the motion, which passed unanimously. <br /> <br />Mayor Craddock introduced for consideration approval of an Ordinance <br />on first reading granting a five-year franchise for transportation of <br />persons and property to the Armadillo Express, the caption which was <br />read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, GRANTING TO ARMADILLO EXPRESS A FRAN- <br />CHISE FOR FIVE (5) YEARS TO OPERATE AND MAINTAIN A <br />VEHICLE FOR THE TRANSPORTATION OF PERSONS AND PROPERTY <br />UPON THE PUBLIC STREETS AND HIGHWAYS OF THE CITY OF SAN <br />MARCOS TO AND FROM POINTS OUTSIDE SAID CITY PURSUANT <br />TO THE PROVISIONS OF THE CONSTITUTION AND LAWS OF THE <br />STATE OF TEXAS, THE CHARTER AND CODE OF ORDINANCES OF <br />THE CITY OF SAN MARCOS; SETTING TERMS AND CONDITIONS <br />FOR SAID TRANSPORTATION ENTERPRISE AND DECLARING AN <br />EFFECTIVE DATE. <br /> <br /> <br />
