4. Executive Session <br />In accordance with the Texas Government Code §551.071- Consultation with Attorney, <br />§551.074 - Personnel Matters and §551.087- Deliberation Regarding Economic Development <br />Matters, the San Marcos City Council convened into Executive Session at 6:08 p.m. on Tuesday, <br />July 6, 2010 in order to discuss matters pertaining to: <br />A. Receive advice of legal counsel regarding matters pertaining to the termination of former City <br />Manager Rick Menchaca. <br />B. Deliberation regarding City Manager vacancy. <br />C. Deliberation on offers of possible incentives to entities considering locating or expanding in <br />the San Marcos community. <br />5. The Executive Session adjourned at 7:30 p.m. on Tuesday, July 6, 2010. The following action <br />was required from Executive Session: <br />MOTION: Upon a motion made by Councilmember Terry and a second by Councilmember <br />Porterfield, the City Council voted six (6) for and none (0) opposed, to appoint Laurie Moyer as <br />Interim City Manager. The motion carried unanimously. <br />MOTION: Upon a motion made by Councilmember Thomaides and a second by <br />Councilmember Terry, the City Council voted six (6) for and none (0) opposed, to accept the <br />Waiver and Release of Claims signed by Rick Menchaca with a six -month severance of $85,000. <br />The motion carried unanimously. • <br />6. Invocation <br />Jeff Kester, with the Baha'i Spiritual Assembly, provided the invocation. <br />7. Pledge of Allegiance <br />Councilmember Porterfield led the assembly in the Pledge of Allegiance. <br />8. Citizen Comments <br />Jean Baggett, 726 W. Hopkins, spoke regarding the neighborhood commission. She said it <br />appears it is the Council's choice to not use CONA as neighborhood representation. There is a <br />structure already in place, and we will be duplicating if we start all over again. She suggested, <br />for purposes of better communication between the neighborhoods and the Council, to work <br />towards a two -way conversation, meeting with each other on a regular basis to keep <br />communication open. She also suggested that it would be good if members of the commission <br />are from the neighborhoods. She recommended that the neighborhoods select their <br />representative and submit that name to the Council. CONA is a good source to get prospective <br />names.
