203. <br />Regular Meeting May 24, 2004 Page 2 <br /> <br />Mayor Narvaiz introduced for consideration approval of one appointment to <br />fill a vacancy on the Planning and Zoning Commission. Mr. Mihalkanin <br />moved to appoint Betsy Robertson to fill the vacancy, which passed <br />unanimously. <br /> <br />Mayor Narvaiz introduced for consideration the confirmation of the City <br />Manager's appointment of Fire Chief, James Baker. Mr. Thomaides moved to <br />confirm appointment of Fire Chief, James Baker and Mr. Guerrero seconded <br />the motion, which passed unanimously. <br /> <br />Mayor Narvaiz introduced for consideration a public hearing and approval <br />of an Ordinance on first reading, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />AMENDING CHAPTER 114, ZONING, OF THE CITY CODE BY ADDING A NEW <br />DIVISION 33 TO ARTICLE 5 TO ESTABLISH A DOWNTOWN BUILDING HEIGHT <br />OVERLAY DISTRICT; INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR <br />PENALTIES. <br /> <br />Mayor Narvaiz opened the public hearing. 1) Charles Meeks encouraged the <br />Council to look at this amendment hard, because he feels this amendment <br />could have an impact on the future. He also encouraged the Council not to <br />vote on this Ordinance until they have time to review the Ordinance. <br />Mayor Narvaiz asked if anyone else wished to speak. No one did, so Mayor <br />Narvaiz closed the hearing. Mr. Thomaides moved for approval of the <br />Ordinance on first reading and Mr. Mihalkanin seconded the motion. Mr. <br />Mihalkanin stated the proposed Ordinance establishes a height limit of <br />four stories for downtown buildings for a period of two years. He thanked <br />everyone for all the hard work on the Downtown Height Overlay District. <br />Mr. Thomaides stated citizens requested establishing a height limit in the <br />downtown area. He stated this proposed Ordinance would automatically be <br />reviewed in two years. Mr. Taylor stated he supports this issue because <br />of the two-year time limit.
