Mr. O'Leary stated in San Marcos anyone <br />who sells alcohol must have a Specific Use Permit for on-premise <br />consumption. He stated the City Code provides for the issuance of penalty <br />points for violations of the stated conditions relating to TABC specific <br />use permits. He stated the Planning and Zoning Commission recommended <br />amendments. Mr. Taylor stated the Planning and Zoning Commission approved <br />these recommended amendments unanimously. Carol Barrett, Director of the <br />Planning Department, stated these recommended amendments clarify <br />definitions. The Council then voted unanimously for the approval of the <br />Ordinance on first reading. <br /> <br />Mayor Habingreither introduced for consideration adoption of an Ordinance <br />on emergency, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />AMENDING THE TRAFFIC REGISTER MAINTAINED UNDER SECTION 82.067 OF THE <br />CITY CODE BY THE ADDITION OF TRAFFIC DIVERTERS ON ALGARITA AND <br />CHAPARRAL STREETS AT THE INTERSECTION OF THOSE STREETS-WITH CRADDOCK <br />AVENUE; INCLUDING PROCEDURAL PROVISIONS; AND DECLARING AN EMERGENCY. <br /> <br />Mr. Mihalkanin moved for adoption of the Ordinance on emergency and Mr. <br />Bose seconded the motion. Mayor Narvaiz stated a citizen has signed up to <br />speak regarding this issue. Valerie Hughson stated she is a resident of <br />Hughson Drive. She stated she is against this Ordinance. She feels with <br />the construction at Craddock and the additional diverter, this will cause <br />more traffic. She encouraged the Council to remove the diverter and <br />replace it with a speed bump on Hughson and to make Algarita and Chaparral <br />one-way. She feels the Council could also place a left turn lane on <br />Hughson to Ranch Road 12 and could add signs ~no left turn". Mr. <br />Mihalkanin inquired if there is an Ordinance to reduce speed at <br />construction sites. Mr. Mark Taylor stated a speed limit could be set by <br />the Council. Mayor Narvaiz inquired how the Council could implement a <br />speed limit. Mr. Mark Taylor stated he will work with the Engineering <br />Department. Mr. Taylor stated reducing the use of public roads concerns <br />him. He stated he will support this until the light is installed and the <br />diverter can be removed. Mayor Narvaiz stated she feels when the <br />construction work is completed, this Ordinance should be reviewed. Laurie <br />Anderson, Director of Engineering, stated construction will begin in late <br />Fall and a temporary sign can be placed for 90 days.
