<br />(c) This article and article 12 of this chapter do not alter the responsibility of any <br />person performing any construction activity for damages to anyone or for <br />performance of a contract. Neither the city nor any city officer or employee <br />assumes any liability on the basis of an inspection activity or a license, certificate <br />or permit issued pursuant to this article or Article 12. <br /> <br />d) ^ person 'Nho meets all other requirements for licensing as a building <br />contractor is exempt from this insurance requirements provided: <br /> <br />(1) the person submits 'Nith the license application a statement under oath <br />that the person is applying for a permit to construct a single family residence on <br />property o'Nned by the person, and the residence '¡¡ill be occupied as the <br />person's homestcad; <br /> <br />(2) the lioense issued to the person ,..till be limited to the obtaining of a <br />building permit to construct one single family residence on the property owned by <br />the person; and <br /> <br />(3) the person has not been issued a building permit 'J'.'ithin the past five <br />years. <br /> <br />SECTION 2. Section 14.374 of the San Marcos City Code, is amended by <br />adding subsections 14.374(e) and (f) as follows: <br /> <br />Sec. 14.374. Application for license. <br /> <br />(e) An applicant for a residential contractor's license shall provide proof of their <br />registration as a contractor with the Texas Residential Construction Commission. <br /> <br />(f) A person who meets all other requirements for licensing as a residential <br />contractor is exempt from registration with Texas Residential Construction <br />Commission provided: <br /> <br />(1) the person submits with the license application a statement under oath <br />that the person is applying for a permit to construct a single family residence on <br />property owned by the person, and the residence will be occupied as the <br />person's homestead; <br /> <br />(2) the license issued to the person will be limited to the obtaining of a <br />building permit to construct one single family residence on the property owned by <br />the person; and <br /> <br />(3) the person has not been issued a building permit within the past five <br />years. <br /> <br />SECTION 3. Section 14.452 of the City Code is amended by adding subsection <br />14.452(g) as follows: <br />
