a) The Project site is not located over the Edwards's Aquifer Recharge Zone; therefore, <br />a water Pollution Abatement Plan (VvTPAP) will not need to be prepared or submitted <br />to the Texas Commission on Environmental Quality (TCEQ) for review. <br />b) The floodplain note will be based on the current flood insurance rate maps prepared <br />by F.E.M.A. or City approved drainage study only. <br />c) The Project will not develop within the "High water Mark" of the floodway; <br />therefore, coordination with the U.S. Army Corps of Engineers is not required nor <br />part of this scope of services. <br />d) The Project does not have any Planned Development District (PDD) restrictions for <br />parks. <br />e) All on-site utility will be private systems and will not require construction inspection <br />fees, plan and profile design, or construction cut sheets. <br />f) It is assumed that the proposed water service line to the girl's fast pitch softball <br />complex portion of the Project restroom facility will not provide fire protection. <br />g) It is anticipated that the restroom facility will be served by a proposed gravity main <br />that will convey the flows to an existing on -site lift station. Design of a new on -site <br />lift station is not included in this proposal. <br />The City will: <br />2.2 Provide full information to the Consultant regarding the City's requirements for the <br />Consultant's services under this Agreement. The City will furnish the Consultant with copies of <br />data and information in the City's possession needed by the Consultant at the Consultant's <br />request. <br />2.3 Designate Rey Garcia, P.E. City Senior Engineer as the City's Project Manager and <br />authorized representative to act on the City's behalf with respect to this Agreement. The City <br />will examine the documents and information submitted by the Consultant and promptly render <br />responses to the Consultant on issues requiring a decision by the City. <br />2.4 Provide access to and make all necessary provisions for the Consultant to enter public <br />and private property as required for the Consultant to perform its services under this Agreement. <br />2.5 Be responsible for the printing and binding of all construction contract manuals. <br />2.6 Provide a copy of the current title report for this property to the Consultant. <br />2.7 Bear all other costs incidental to this Article. <br />ARTICLE 3 <br />CONSTRUCTION COST <br />3A DEFINITION <br />Luck Design — Gary Sports Complex Improvements — Phase I Project Agreement <br />14 <br />
