1.4.4 Use its best professional judgment to create technical documents that comply with <br />applicable construction and development codes, local regulations and ordinances and other <br />federal and state regulations which are known or which should reasonably be known to the <br />Consultant (including those required under the ADA and Article 9102, v.A.C.S., Architectural <br />Barriers Act). The Consultant will be responsible for notifying the City of requirements of the <br />Architectural Barriers Act and any other requirements by the Texas Department of Licensing and <br />Regulation ( "TDLR "). The Consultant will be responsible for registering the Project for <br />accessibility review with TDLR or the appropriate authorized agent as required prior to <br />construction and will make design modifications specifically identified by TDLR or the <br />appropriate authorized agent as part of its pre - construction review. In addition, the Consultant <br />will prepare documents and drawings as reasonably required by the following governmental <br />authorities to comply with permitting requirements that are in effect on the date of this <br />Agreement: <br />a) The City of San Marcos "Comprehensive Site Preparation Application" permit; <br />b) Asbestos survey submittal to the City of San Marcos Permit Center; and <br />C) Texas Commission for Environmental Quality (TCEQ) - Stormwater Prevention <br />Plan (SWPPP). <br />1.4.5 As is reasonably necessary, evaluate, confer and respond to government staff and review <br />comments regarding the proposed project, including attending public hearings to address <br />permitting issues as applicable. <br />1.4.5 Make design modifications as requested by the applicable governmental authorities and <br />approved by the City as they apply to the Project. <br />1.4.7 Prepare schematic plans at 30% and 60% completion of construction document <br />preparation including site improvements illustrating general locations, sizes and relationships of <br />improvements, materials and forms of construction, and proposed equipment for use in <br />development of the park facilities. The Consultant will show these details in the context of the <br />topographic and boundary survey. In addition, the Consultant will include material cut - sheets as <br />necessary to illustrate design characteristics of selected equipment, finishes and materials. <br />1.4.8 Prepare and provide the City with a revised opinion of probable construction costs. In <br />addition, the Consultant will review technical plans with the City to document the City's <br />comments for use in preparation of design development plans. <br />1.5 TASK 5 — FINAL DESIGN <br />This task includes the preparation of plans, specifications for insertion into bid -ready <br />contract documents and a final construction cost estimate for the girl's fast pitch softball <br />complex portion of the Project.
